Moving to VA with guns
Moving to VA with guns
Gents,
I'm going to be executing a move to VA (Norfolk) for my new set of orders, and I want to make sure I'm following the letter of the law with everything that I would be bringing. I've read through the NRA's page on VA and it seems like a fairly "gun friendly" state, I just want to make sure I've got my bases covered.
Is there any magazine capacity restriction? From what I've ready, I haven't seen any for rifles or handguns.
Is there any issue with bringing hollow point ammunition? Are there any brands that might be an issue?
Can someone clarify what an "assault firearm" is supposed to be? Would a rifle with magazines less than 20 rounds not count then?
Thanks for you help guys!

First,
As to your questions, off the top of my head:
no magazine restrictions that i am aware of
no problems with hollow points
On the right side of this page is a group of "Legal Resources", the link to "Code of Virginia" http://vagunforum.net/virginia-laws/cod ... ws-t2.html I believe will help you with your questions.

Here's what the Code of Virginia has to say concerning "assault rifles" and magazine capacity.
http://lis.virginia.gov/cgi-bin/legp604 ... 18.2-287.4
http://lis.virginia.gov/cgi-bin/legp604 ... 2-308.2C01
There is another section pertaining to handgun magazine capacity, but I'm not able to find it. I'm sure someone else will chime in shortly.
There are no restrictions on hollow point ammunition.

Technically, more than 20 rounds is illegal, but its one of those weird statutes with different hoops you'd have to jump through to be breaking the law.
18.2-287.4. Carrying loaded firearms in public areas prohibited; penalty.
It shall be unlawful for any person to carry a loaded (a) semi-automatic center-fire rifle or pistol that expels single or multiple projectiles by action of an explosion of a combustible material and is equipped at the time of the offense with a magazine that will hold more than 20 rounds of ammunition or designed by the manufacturer to accommodate a silencer or equipped with a folding stock or (b) shotgun with a magazine that will hold more than seven rounds of the longest ammunition for which it is chambered on or about his person on any public street, road, alley, sidewalk, public right-of-way, or in any public park or any other place of whatever nature that is open to the public in the Cities of Alexandria, Chesapeake, Fairfax, Falls Church, Newport News, Norfolk, Richmond, or Virginia Beach or in the Counties of Arlington, Fairfax, Henrico, Loudoun, or Prince William.
The provisions of this section shall not apply to law-enforcement officers, licensed security guards, military personnel in the performance of their lawful duties, or any person having a valid concealed handgun permit or to any person actually engaged in lawful hunting or lawful recreational shooting activities at an established shooting range or shooting contest. Any person violating the provisions of this section shall be guilty of a Class 1 misdemeanor.
The exemptions set forth in § 18.2-308 shall apply, mutatis mutandis, to the provisions of this section.

Re: Moving to VA with guns
Came up with another question about "Restricted Firearms Ammunition"
§ 18.2-308.3. Use or attempted use of restricted ammunition in commission or attempted commission of crimes prohibited; penalty.
A. When used in this section:
"Restricted firearm ammunition" applies to bullets, projectiles or other types of ammunition that are: (i) coated with or contain, in whole or in part, polytetrafluorethylene or a similar product, (ii) commonly known as "KTW" bullets or "French Arcanes," or (iii) any cartridges containing bullets coated with a plastic substance with other than lead or lead alloy cores, jacketed bullets with other than lead or lead alloy cores, or cartridges of which the bullet itself is wholly comprised of a metal or metal alloy other than lead. This definition shall not be construed to include shotgun shells or solid plastic bullets.
B. It shall be unlawful for any person to knowingly use or attempt to use restricted firearm ammunition while committing or attempting to commit a crime. Violation of this section shall constitute a separate and distinct felony and any person found guilty thereof shall be guilty of a Class 5 felony.
Under part (iii) which it talks about plastic substance in a bullet, would this make something like Hornady's Critical Defense ammo illegal? To me this is a "no" because the core is lead, but the tip is a polymer I believe.
Any experience with this?

ammo made to pierce kevlar is frowned upon... pretty self explanatory. You can shoot intruders, but should not be equipped to take down a swat team. No depleted uranium round for you.

With respect to above underlined, What about all copper bullets? For example:§ 18.2-308.3. Use or attempted use of restricted ammunition in commission or attempted commission of crimes prohibited; penalty.

Re: Moving to VA with guns
The ammunition law is effective only if you attempt to commit a crime while using the named ammo. Don't commit crime and you're fine.
Be aware that Streetsweepers and Striker-12s are illegal regardless of whether they have been registered with the feds. Semiauto folding stock shotguns with twelve round drums are also illegal. That's it as far as outright bans go.
Get your concealed carry permit and you don't have to worry about some of the dumber laws, like one-handgun-per-month and the Gun Free School Zone Act.

That's really only an issue when purchasing/transferring from a dealer. Otherwise it's ignored (including by many dealers).NozeMan wrote:Can someone clarify what an "assault firearm" is supposed to be?

Don't "move" through New Joisey on your way here, buddy!
Also, WELCOME and apparently THANK YOU for your service to our country!
You will have no problems here. All of your concerns are legally acceptable behavior. If you are white, you can expect no trouble from the "law enforcement communitah" in the Newport News area.
If you are not able to claim membership the race that is soon to no longer be a majority in America (2042, as of this writing), you can expect large financial remuneration in a court of law from the idjits there. One young negro gentleman has received two cash settlements and I believe a third is pending for his unlawful detainment and arrests/disarmament.
Also don't go near Surry county. I don't care who you are. Damn sure keep your pointer finger holstered at all times if you must.

The Surry county prosecutor does look the other way though if you were interested in electrocuting, choking or body slamming dogs to their death though. Not certain if the prerequisites for this exemption are being A) a rich B) a negro C) a pro football player or D) all of the above. Best not test them waters.

Re: Moving to VA with guns
Several rules of thumb;
If you can pick it up and carry it, if it's a breach loader, uses a cartridge rather then a rocket, it's legal.
If it has it's own wheels and loads from the muzzle it's legal.
If it doesn't violate Federal laws it's legal.
Welcome to Virginia.
