Question on Legality

Post by jreading »

I have a p230 that was given to me from an uncle years ago (about 10yrs. actually). He had the gun in Florida, but I've had it ever since in NY and now VA. When I had it in NY, it was a dust collector with no mag. I recently got into using this thing and have since cleaned it and got a factory mag. I know VA and FL have no registrations and I'm 99.999999% sure this thing was never used in a crime, so am I in the clear?

Your'e good to go. In the clear, whatever you want to call it. I'm sure someone will chime in saying you need to get the serial number ran and a copy of your first borns birth certificate  but if I were you i'd use it a not have a worry.

Meh. Just make sure you file off any serial numbers before you carry it, and you'll be ok. HAAAAA! (snark alert!)

Just to be clear chfaunce was kidding. You should be fine, enjoy your pistol!

Thanks, for the advice. Looking forward to snaking it and cleaning the heck out of it and lubing it. Going to replace the main spring and the recoil spring, since I have those as well. Will post another thread about the cleaning/oil products I got, because I just bought a bunch without really knowing what to get.

I can't speak to local/state laws for NY and FL as I'm only familiar with VA.

If you and the uncle were not residents of the same state when the pistol was given to you, then an illegal transfer has occurred. Face to face transfers of firearms can only occur between residents of the same state. If you are residents of different states the transfer has to go though a FFL.

While a good point, I think in this case it's moot. I'm pretty sure the statute of limitations ran out years ago.

Yep, its a either a 3 or 5 year limit I believe, I can't find the exact section of code right at the moment. But just wanted to make sure the knowledge got out there that FTF transfers of handguns can only be between residents of the same state.
