You are right, states rights doesn't allow them to violate a protected enumerated right. Sadly the 17th amendment theoretically eliminated most of the powers of the individual states.SHMIV wrote:I don't know that it does affect States Rights, in this particular instance. Assuming that this can pass, this would kill a large number of oppressive laws in states like New York, California, etc.
Besides, it's not like the Fed will be taking over anything, anymore than they already have. If the Fed wants to make federal gun laws more oppressive, they will do so, without this legislation. Hell, they already have, in the past. Consider suppressors and full-auto rifles, for example.
