The legislation allows police chiefs to ask courts to deny firearms identification cards needed to buy guns to individuals they feel are unfit to obtain them, toughens penalties for some gun-based crimes, creates an online portal for background checks in private gun sales, carves out a firearms trafficking unit within the state's police department and requires that Massachusetts join the National Instant Background Check System.

It is available. Anyone that wants to do a background check on someone can do it online. That's what hotels and property managers use.

Of course, mandating the use of such, in private sales, I wouldn't support. If one is required to use background checks, then a record must be kept, otherwise the law is unenforceable. And, if records are kept, that kind of screws over the more paranoid of us that like to keep our gun ownership under the radar.
