In regards to the latest incident in Las Vegas, I've been wondering what would have happened if Wilcox had engaged Miller from behind. Do you think he would be charged?

Yes, Miller fired a round into the ceiling, displaying his Ability, Opportunity, and Means. We don't know if Miller was pointing the gun at any of the shoppers (so defense of others might not come into play) and since Wilcox was apparently behind Miller could he claim imminent danger?

Personally, I don't think so, especially with the LE murders. But Wilcox didn't know about those at the time he attempted to engage.

This can only provoke opinion. Keep in mind, if there is overwhelming evidence of a crime or a complete lack of evidence of a crime, it is ultimately up to the State's Attorney to make a choice to pursue a case.

I can tell you this, in my opinion, I think if most people witness a situation, they can typically tell if a weapon was discharged by negligence or if they have intent to kill.

If someone's actions give me reason to fear for my life or the lives of others and fleeing is not an option for everyone at risk, I will not hesitate to drop a soft target. I don't care what direction they are facing. In fact, if they are facing away, that would be ideal.

If a person is angrily firing shots in a building full of people. Why give someone who clearly already demonstrated that they are ready to kill, an opportunity to ID me as a target and try to kill me first? I have no obligation to let a person who just committed murder or obviously appears ready to commit murder, any warning they are about to die.

I believe that a jury of my peers would call that justifiable or excusable homicide... assuming it even gets that far.

Now, with all that said... this will really bake your noodle.

In today's world of citizens from all walks of life CC'ing, if you witness a shooting, how do you know the person you just saw pull the trigger is a bad guy who just shot someone, or a good guy who just shot someone? How bad you you feel if you mistakenly but purposefully shot a person who just saved a stabbing victim?

Lots to think about before you even make a choice to go for your weapon.
