Winter Haven, Florida -- Winter Haven Police say an alleged burglar was shot to death as he tried breaking into a home on Monday morning.

I would never fire a warning shot. Its dangerous, a waste of ammo and likely illegal depending on your state and local laws as well as where the instance occurs (brandishing, negligent discharge, etc.).

If you have audible or visual confirmation, 1.) Call the police 2.) Tell the intruder to go away 3.) Use force as appropriate, up to and including lethal force.

I agree on the warning shot. Florida is in the process of passing or has passed a bill saying warning shots and showing the weapon (brandishing) is also legal if you would be justified in shooting.

Good on them. I don't fire warning shots. I might yell to get lost that I was armed, but if I am too scared or don't have time for that too bad for you.

Here is an example of the warning shot being a bad idea as mentioned. Don't know if you guys remember this or not.

The part that blows my mind is, both cases are in the exact same state. In the story Winever posted... no charges at all. In the story I linked, convicted with a 20 year sentence and possibly going for 60 years.
