A question about selling an AR.

I put one of my AR15s on Armslist. I was contacted by a local guy who wants to buy it. He said he lives here in VA but still holds a Texas DL. He said is only here for a few years for a job contract. According to VA, he is a VA resident. However, I am a bit reluctant to sell it to him since he does not have a VA DL. Am I wrong? What are my options? Sorry for all the questions, I lived in MD too long and I am still trying to get reacquainted with VA laws. Thanks.

If you are the least bit reluctant, go throug a ffl or find someone else to sell to. Who you sell to is entirely up to you. You do not have to sell it to that person.

Thanks for the quick response Gene. My reluctance is mainly due to me questioning the legality of it. Would we still be able to do a FTF or have to go to an FFL?

That's the beauty of being the seller - if you're not comfortable, set the terms that make you comfortable. In this case with a TX DL I'd personally go through a FFL. If you don't want to do that, sell to someone else with a VA DL!

Thanks ShotgunBlast. I'll probably go FFL but is it legal to do a FTF sale in this situation? In MD, ARs were treated the same as Pistols (regulated firearm) so you HAD to go through an FFL. Are ARs in VA treated the same as any other long rifle? Thanks again everyone.

If that guy is going to be in VA for several years and is interested in buying an AR from you or anyone else He should get a VADL anyhow ! :ak47:

It is legal to do a FTF transaction if both the buyer and seller are VA residents. How do most people prove residency? With a VA DL. Your buyer doesn't have that, but could probably produce a utility bill to prove residency. Whether that's good enough for you is up to you.

ARs are treated just like any other long gun in VA.

AR's are a little different than other long Guns....Last October I purchased 2 Bushmaster Carbon 15's from Dance's in Colonial Hghts....I had to prove US Citizenship . Photo ID plus Voter Card. I usally use VADL and CHP for Firearms Purchasing. I was told that being an AR is why Proof of Citizenship was required. This was my 6th and 7th firearm purchase of the year at Dance's .

Yes, because it is has a detachable box magazine and a flash hider or somesuch. Doesn't make sense to me. A voter reg card can be used for proof of citizenship, iirc. Kind of funny, in an ironic sense, given all the nonsense around actually voting and the laws surrounding it.

Thanks everyone. I ended up calling the VSP and they said he just has to prove citizenship ( as some of you stated). Buyer is bringing passport & his TX DL.
