S 374 transfer ban

Post by GregVa »

U.S. Senate Judiciary Committee Passes Semi-Auto and Private Sales Bans

Wow this is bad.. really bad. They want to make it hard for gun owners to do anything :

1. Teaching someone to shoot on your own land is a felony, 5 years, if you hand them the gun. Not an exempted transfer.
2. No exception for state permits. All transfers must go through a dealer or 5 years in federal prison.
3. Actually, even married couples are questionably legal, because the exemption between family only applies to gifts, not to temporary transfers. The 7 day implication is if you leave your spouse at home for more than 7 days, it’s an unlawful transfer, and you’re a 5 year felon. I suppose you could gift them to your spouse, or related co-habitant, and then have them gift them back when you arrive back home. Maybe the Attorney General will decide to create a form for that.

Also if you are in a dangerous situation, and you hand your gun to your friend to help you defend yourself. Say on the side of the road broken down, you are a felon, and will go to jail 5 years!

I think the above ban passed the senate, but has not passed congress. So hopefully it will not make it into law.
Write your reps and tell them this is wrong!

It passed a committee, not the full Senate. But yes, let your reps know they will not win another term on this one, tell them you are a single issue voter, etc. Don't stand silent!

Here's the end game:

If you make an illegal transfer by your absence at home. You home may be forfeited to the US Government.

If you make an illegal transfer by taking your child hunting, that property may be forfeited to the US Government.

If this law stands, Asset Forfeiture statues will be modified to include this section of US Code. It's a rubber stamp.

Trust me.
