Hello,

I'm a little confused by the language for one of the reasons for denial of a CCP application.

7. An individual who has been convicted of two or more misdemeanors within the five-year period immediately preceding the application, if one of the misdemeanors was a Class 1 misdemeanor, but the judge shall have the discretion to deny a permit for two or more misdemeanors that are not Class 1. Traffic infractions and misdemeanors set forth in Title 46.2 shall not be considered for purposes of this disqualification.

I have had one Class 1 misdemeanor back in 11/2008. Will that make me ineligible for a CCP? How I'm interpreting it is that you will be denied if you have had two or more misdemeanors in a 5 year period.

You should be ok.
You would be denied if you have two misdemeanors, if one is class 1 -- no questions.
The judge can use discretion and deny if you have two misdemeanors (or more) even if none of them are class 1.
If you have only one, you're in the "not two or more" category, which means you shouldn't be disqualified (on the basis of this section, obviously you have to meet all other requirements).

That's what I thought. Sometimes when you read the language over and over you begin to question yourself. I feel better about it now. I just did not want it to get denied.
