New Ammo Purchasing Law or Policy for Dicks Sporting Goods??

Post by eternity059 »

So a group of friends and I have a range trip planned in the next few hours and we had an interesting experience. My friend who is Indian, permanent resident in the U.S went into the local Dick's Sporting Goods in Bailey's Crossroads in Northern Virginia to purchase ammo last night for our range trip and was denied purchase because he was not a citizen of the U.S. He said the signature pad now has a question on Ammo purchase of whether you are a citizen or not. He answered no last night and was denied ammo purchase although he has purchased over 1000+ rounds in the past 6 months.

He went again today and answered yes this time and purchased the ammo with awkward looks.

Is there a new law or policy that I am not aware of? I am not a citizen of the U.S and am a permanent resident and have purchased multiple firearms legally. If there is, I will never buy ammo from Dicks again.

From the ATF website.... and IANAL.

http://www.atf.gov/firearms/faq/unlicen ... strictions
Q: Are there certain persons who cannot legally receive or possess firearms and/or ammunition?
Yes, a person who —

Has been convicted in any court of a crime punishable by imprisonment for a term exceeding 1 year;
Is a fugitive from justice;
Is an unlawful user of or addicted to any controlled substance;
Has been adjudicated as a mental defective or has been committed to a mental institution;
Is an alien illegally or unlawfully in the United States or an alien admitted to the United States under a nonimmigrant visa;
Has been discharged from the Armed Forces under dishonorable conditions;
Having been a citizen of the United States, has renounced his or her citizenship;
Is subject to a court order that restrains the person from harassing, stalking, or threatening an intimate partner or child of such intimate partner; or
Has been convicted of a misdemeanor crime of domestic violence
Cannot lawfully receive, possess, ship, or transport a firearm.
A person who is under indictment or information for a crime punishable by imprisonment for a term exceeding 1 year cannot lawfully receive a firearm.

Such person may continue to lawfully possess firearms obtained prior to the indictment or information.

[18 U.S.C. 922(g) and (n), 27 CFR 478.32]
How does this factor in? Does permanent resident = nonimmgrant visa? I don't know immigration laws... If it is legal, though, why lie about it? Just go somewhere else...

That must be a thing with Dick's. I haven't encountered that before.

And permanent residents are immigrant aliens. So anything affecting NON-immigrant aliens does not apply to them.
The price of freedom is eternal vigilance... wait... when did that happen?

A non-immigrant visa would be a limited time visa, i.e. a tourist visa, perhaps also a student visa.

Sounds like it might be worth a nicely worded letter to Dicks corporate office. Explaining that their question is a bit off vs. the law.

They don't call em Dicks for nothing.... :)
I had a SCAR 17 and 16. I also had a bunch of Glocks and a couple H&K pistols. Oh and a DDM4, but I sold everything when our government told me these dangerous tools can actually hurt someone. Apparently they grow legs and go on killing sprees.

Wow i didn't even know that Dick's sold ammo. What is their pricing like? Any good? I'd think they are opening themselves up to a discrimination lawsuit of some sort if the policy they have isn't actually enforcing a law on the books. God knows there are a lot of "permanent residents" in that area too. I live pretty close to Bailey's.

Dick's does sell ammo, but Walmart beats them price wise. Maybe that's why they have ammo in stock while Walmart is sold out all of the time.

I purchase ammo at Dick's because they are cheaper for their 50 rd boxes of blazer's which are $10.99. The cheapest Walmart has is $11.97 for 50 rds of federal unless they have the 100 rd value pack in which case, I load up to how ever much they allow me to buy which is usually 6 boxes. I have about 1000 rounds I keep at home as a just in case and don't usually fall below that mark. Dick's and Walmart in my areas (sterling, falls Church) is usually sold out of 9mm

Why did your friend get awkward looks at the Bailey Crossroads Dicks store? Or did he get awkward looks at another store? If it was at Bailey Crossroads, I am surprised. I can see him getting awkard looks at a gun store out in a more rural redneck area but not at Bailey Crossroads.LOL
