State police machine gun registration

One of my machine guns has been approved 3 days ago and I am awaiting the paperwork to come back. Is It true that in VA I will not be able to take my machine gun out of the house to use until the state police takes the 6-7 months to complete my registration OR will I be issued a temp document to use in its place?

The VA SP do not take six months to give your paper work back. In most cases its been a few weeks.

You __DID__ keep a copy of the form you sent right? Just keep that with your form 1/4 and it will serve as evidence of notification of the State Police.

The offense here is possession without notifying the SP... how could you have it in your home with out the form then? There is nothing in the law that says anything about you can't take it out of the house.

If you dealer felt that way he never should have let you take it home until the form was approved. Does he even realize that as a dealer he HAS to register everything in HIS possession with the VASP?

Your dealer is a dipshit and has nearly no idea what he is talking about.

I've not recieved my machine gun yet. It was approved on the 13th and I'm waiting for the stamp to get back to the dealer.

I just wanted to get my ducks in a row and line up things so it goes smoothly when I do go pick it up. My dealer has a odd scedule and the only time we can ever meet up is on my lunch break. Since I work 6 days a week, my break is 30 minutes, his shop is 30 minutes round trip, and my boss hates giving me any extra time off. I'm kinda forced to streamline things so I dont get yelled at when I get back

Fill out your form ahead of time, just sign and date it when you're in front of the notary.

What I usually do is send it by either registered or certified mail, with a return receipt. Depending on how fast the various arms of government are working, I may get the reciept back a week or two before the certificate; once or twice I've gotten the certificate before the receipt. Anyway, with this you have proof that you sent the form, personally I deem that sufficient for playtime before the green form comes in.

Your dealer is silghtly misinformed. The law, as it is written, is extremely strict. One aspect of it is that failure to produce the certificate on demand is statutory grounds for the involved officer to seize the machinegun(s) and initiate forfeiture proceedings. However, as the law is enforced, unless you're engaged in a real crime (or are suspected of one), or the officer doesn't like you, it never gets that far. Most cops are unaware the state even has the Uniform Machine Gun Act; show them the federal registration and they're usually satisfied (even though the fed form means nothing from a state perspective).
