Ray's Hellburger Robbed by Armed Men

Post by seanc »

Just wanted to share the following story about a burger place in Arlington I find myself at occasionally, mostly on date night. It's troubling to think that I could have been eating while these men came in to rob the place.

Now, I pose the question, if you were eating dinner there and saw men enter, one armed, how should the armed citizen respond legally in this situation? This place is normally packed full of people.

If they are just stealing stuff--get a good look at them and take note of any and all distinguishing features. I am not a police officer, if someone is being hurt I would stop it, but if it is just stuff then let the insurance fix it. However in a crowded place, a shoot-out is an exceedingly bad idea.

In such a situation, unless a barrel is being leveled at you, taking a shot might not have an affirmative defense, however, the up side is that since there was a strongarm robbery underway, any loss of life is supposed to automatically go to whomever is conducting the crime.

However, the best thing is as MBC stated: be a good witness. Defense of other life? Yes. Defense of other property? Not advisable.
