Illegal alien child killer released with no bail

I live in Manassas and have been following this story. This scumbag beat his 3 month old son to death. A judge just let him go against state law to avoid violating his "rights" to a speedy trial. This is an outrage and I am betting he will soon be if not already out of the country:

MANASSAS, Va. --

The trial of a Manassas-are man charged in the death of his 3-month-old son was postponed Tuesday, after a prosecution witness did not show up for court.

Henry L. Morales, 26, is charged with felony murder in the death of his infant son, Dominic.
He was set to stand trial before a judge Tuesday, but Dr. A. Wayne Williams, a former medical examiner, did not appear for the trial.

The judge agreed to postpone the trial to Dec. 6.

Morales was first charged with felony child abuse and aggravated malicious wounding after police responded to his house in the 10800 block of Daisy Court on Oct. 17 for reports of a baby not breathing.

He was charged with felony murder after the baby died of his injuries a few weeks later.
According to court documents, Morales told police that he tripped while carrying the baby down the steps and dropped him.

Morales has been held without bond since then. Tuesday, because the trial was postponed, a judge agreed to release Morales on his personal recognizance to avoid violating his right to a speedy trial.

Morales is a citizen of Guatemala and, in addition to the criminal charge, is being held on an Immigration and Customs Enforcement detainer.

My guess is he will only leave the country if forced and my guess is also that the chance of that happening is slim to none with none sitting on a hill watching slim leave town...of course if this were a citizen of the good ole US of A the father would be front page news with police trying to figure out if he dropped the poor child or not...

Folks just like the war on drugs we be losing the war (if there ever was one) on illegal immigration...mexicans (yeah, I know they are all hispanics but so what) are taking over. I took Young to what used to be a Korean supermarket yesterday...not anymore muchachos...it now be a mexican supermarket...

And once again we have the mexicans taking siestas on top of our hills as they watch the residents of once decent communities leave town...

Not having any opinion one way or another about that whole issue at least she is a citizen and afforded rights under the Constitution. Due process and justice, such as it is, prevailed and she had her day(s) in court. Found not guilty, etc, etc, etc....in this case an illegal alien gets to walk without any fanfare at all...

Btw, it amazes me that the death of a child and the familial drama can rivet an entire nation...not me...I just never got a charge from chasing the sound of fire engines to watch someones house burn down...whats even more amazing is the way the lame stream media makes a circus out of the whole affair. Let the little girl rest in peace. Her murder will one day be brought to justice...

Lets get focused on the real problems of those that the so called justice system lets walk due to fear of being labeled or better yet keep them out to begin with...

It says he's being held on an ICE detainer, so no, he hasn't gone anywhere.
He may have been released on his PR for that charge, but since ICE said they wanted him, he should still be sitting in that jail cell.
That or they transferred him to one of the many jails they keep their detainees in.

Now, if that's not the case then someone at the release department of the local jail really screwed up.

Police originally arrested him in October when the injuries were not consistent with his story. 2200 felon illegals have been released by the ADC in PWC since we went 287 (g) in 2007 because of The ICE backlog.

Mr Z I hate to be the first to say this, but the constitution applies to everyone subject to the jurisdiction of the U.S., not just citizens. If you are here, and not a diplomat enjoying diplomatic immunity the laws of the U.S. are applicable to you. We do however agree 100% on the Casey Anthony case. From the non-stop cable programing, especially the Nancy Grace program, right down to fights to get into the court room one would think the tragic death of this infant child, and the resulting trial was the most important trial of the year.

Unfortunately all too often children are frequently murdered, molested, and neglected by the those who should be protecting them. So why was this story so different? Who ceaselessly beat the drum on this case? An entire part of the shock media convinced people that Casey was guilty as sin. Have the talking heads learned a lesson yet? Of course not, in a week or so they will be sensationalizing some other case.

I suspect the dysfunctional family, and Casey herself as the so-called hottie was ready made for the talking heads to exploit. Is it over? Nope, now comes the books, paid interviews, movies, TV reality show, etc. Will we make this woman, based on the death of her daughter, our newest millionaire? I hope not. What on earth does this say about us as a people? I shudder to think.

@Gat6 - please provide at least one citation from a source other than the court that supports your argument that the Constitution applies to everyone...if thats the case then please explain why the illegal being held in TX and scheduled for execution should not be executed...the administration contends that his rights under a UN treaty were violated and he must be afforded the counsel of the mexican government. The man reportedly came here when he was 2 years old (yes, brought in by his parents) and brutally murdered a young girl about 20 years later while residing here (illegally) that entire time...

If what you say is true then why is the administration trying to remove him from the TX justice systems verdict and treat him like a foreign national although he had been here for 2 decades before killing that girl...

And yes I realize I'm mixing several different issues but I'm sure you can process...

It can only be a detainer if he's already incarcerated. A detainer is one jurisdiction telling another, "Oh! You have Inmate So-and-so. Please, hold him and we will take custody." Therefore, he should still be in PW custody waiting for ICE to take custody.
If that's not the case, someone screwed up by letting him go within the allotted time or the time on the detainer expired.
Now, if ICE took him and then released him, that's on them. However, it's not uncommon for them to release a detainer.

Update: Apparently the prosecution witness showed up before he could be released and he was tried and convicted of felony murder before a judge. I do believe the judge erred when he ordered his release and it was caught.
