Postal carry

Post by cyras21 »

Im not questioning the legality of it...

What I would like to know is if any of have noticed the absence of posted signs on postal property?

The post office in Stephens City and the main branch in Winchester are no longer posted.

New era?

Probably can no longer afford to buy the signs. However, they will find the funds to prosecute you to the fullest extent of the law for carrying on federal property.

Go figure.

Are you sure that there's not a poster up on a bulletin board or something similar? Perhaps not a sign on the door, but I'd be surprised if it wasn't posted "somewhere".

IIRC, The sign is supposed to be posted at the outermost entrance and there's some kind of thing in section 232 of the CFR that says if the sign isn't posted properly, you can't be held accontable....but I'm not gonna test that!

Based on the latest info from the VCDL:

http://www.vcdl.org/static/ccw.html

Places Where Carrying Concealed is Prohibited
NOTE: In most locations where concealed carry (CC) is prohibited, open carry (OC) is also prohibited.
- Federal facilities (buildings) (18USC § 930)
- Many federal agency lands (various federal regs, e.g., USPS, but not National Parks)

I think the man would treat this as a case of ignorance is no excuse. USPOs are federal property and carry of any type of weapon is forbidden.

I thought that someone with a CHP could conceal carry at a post office based on the the clause (d) - (3) of the following code.

http://www.law.cornell.edu/uscode/html/ ... -000-.html

I would like someone to clarify what does the phase "other lawful purposes" in this clause mean? I was told that it meant that we, conceal carry permit holders, were legally carrying with our permit and so we could carry at a post office. If someone disagrees with this view then what is this phase "other lawful purposes" referring to? I am not trying to pick a fight here; I just REALLY want it to be clear one way or the other. Either we can or we can not and what is you opinion based on.

That doesnt apply to the Post Office. The Code of Federal Regulations applies, according to the 5th Circuit Court of Appeals:

This is something that we discuss in our Intro to Concealed Carry in Va. class.

Why does it not apply to the post office?

Based on what law?

What does "other lawful purposes" mean then and what does it apply to?

I;ve always felt that legal carry OC or CC should be allowed there but sadly they don't and I haven;t got a few extra thousand to spare to take them on.. I have noticed that those signs sometimes are a real PITA to find but are there..Not like they're bright orange and flashing......

39 USC 410

I'm not going to answer this question, except to point out that the statute prohibiting the possession of firearms in "federal facilities" specifically states that if the property is not posted with a conspicuous notice and the individual charged didn't know better, then that is a complete defense to the charge. I.e., "not guilty".

+1

I'd have to look up the wording but IIRC it says something about being posted at the outermost door.....something like that. The whole thing is a damn mess.

I'm sure only disgruntled employees ( :ak47: ) and criminals can carry. As with anything the government can control the rights of the law abiding citizens are restrained by the acts of those who couldn't care less what they laws.

My suggestion: Drop you stuff in the blue box outside or send it UPS.

The problem is that if the excemption, "other lawful purposes" does not apply then no one can even drive onto post office property with a firearm in the car. So then you won't be able to drop off your outgoing mail in the blue box outside in the parking lot. Fereral property not just inside the building.

I am tried of basing where I can and can not carry my handgun on someones interpretation of the law, that is why I want to know what law they are basing their opinion on, so that I can read it for myself and then come to my own opinion.

Because if we don't ask questions about what the law says then all of us in Virginia would still be under the impression that we could not carry into a place of worship. "....with out good a suficant reason."
