VA and SBS (NFA)

Hello,

I live in Indiana, and I'm trying to help a friend that has a father in VA. He has fired my Serbu Super Shorty, which must be registered in IN as an AOW because Short Barreled shotgun is illegal in IN, but these are legal as an AOW.

What is the situation on these within the laws of VA? I want to make sure he gets correct information and I am unsure where to find this. I looked through your VA legal resources (nice section BTW) and I must have missed it.

Any help would be appreciated. Thanks.

The NFA is national there is no getting around the requirement to submit the ATF forms and pay the tax. I do not believe you have to register an AOW with the state of VA. I'll double check when I get to a real computer or someone will back me up. One or the other!

Virginia does have tighter rules for short-barreled rifles and shotguns, but possession is generally legal if you have it registered with the feds. Just don't use it for crime. No state registration needed. (The statute is at COV §18.2-299 et seq.)

As far as your friend's father getting one, he can order it from a local dealer. Some carry them as stock if he doesn't want anything other than what's in the display case. He has options if he's getting it special ordered, as far as the registration goes he can have the AOW version or Serbu will (or at least used to) register it as a SBS, allowing him to have a stock. It's just another $195 in taxes.

He may also want to look at the Safety Harbor Firearms KEG-12. It's a bit better than the Serbu and a fair bit cheaper.

I wanted to give him accurate information for the state he lives in. He's not a big firearms guy, and while I'm confident in MOST NFA things, I know SBS laws can vary by state. SBS is ILLEGAL in IN so it must be registered as an AOW.
