Return of Fingerprint Card for CHP

Post by bullseye »

For those who live in localities where fingerprinting is required, has anyone ever requested to have the card returned? Have you ever been notified as the law requires? I think I must be the first one in Newport News to ask when/where can I come pick it up!

Since I was required by local ordinance to submit fingerprints I feel that the locality must also comply with the law, to wit, § 18.2-308D. http://leg1.state.va.us/cgi-bin/legp504 ... d+18.2-308 ...Upon completion of the criminal history records check, the State Police shall return the fingerprint cards to the submitting local agency or, in the case of scanned fingerprints, destroy the electronic record. The local agency shall then promptly notify the person that he has 21 days from the date of the notice to request return of the fingerprint cards, if any.
Remember, shall means is required to.

I received my CHP in the mail last Friday. So, Wednesday I decided to call and find out where to pick up my prints. I called the Circuit Court where, several transfers later, I spoke with someone told me to call the NNPD Precinct where I was printed. The 2nd person at the Precinct gave me a # to call at the Main office; wrong #, told to call info desk. The Info desk put me on hold twice trying to find the answer. Well, the answer was to call back on Thursday because the two people who handle the permits were off duty.

Today I call back and am told by NNPD "the VSP doesn't return the prints to us." Hmmm... what's going on with the rule of law... A call to the VSP Division Five office gave me the # to Richmond. But I have to call Richmond back in the morning because it was after 1630 and the fingerprint office had closed.

I've lost count of how many people I've spoken to (they were all very nice) in the five different locations I've had to call. And so far EVERYONE appears to ignorant of the law, as they all have claimed "negative knowledge"!

Updates later!

Very interesting situation and I'm glad you're following up on it! Fingerprinting isn't required here in King George County, so I didn't have to deal with the issue. I agree with your understanding of the law. Wouldn't it be nice if people charged with upholding the law knew what they were upholding? It's up to diligent citizens like you to hold their feet to the fire until you get what is promised to you by the law.

Can't wait to hear the outcome!

When I got my CHP in Fauquier Co, the Sheriff's office did the printing. When the BI was done and the green light given to the County Clerks office to proceed with the p/w, the Sheriff's office notified me I could come and pickup the cards or they would destroy them as they were no longer needed. I took them and have them filed away.

I was able to pick up my fingerprint card from NNPD yesterday. The Circuit Court's office was able to track it down for me, although it took them a few calls to get the right answers! They were initially informed that all CHP prints were done electronically. They had to make some more calls after I reiterated that mine where inked.
