VA-ALERT: ACTION ITEM: Et Tu, Cuccinelli?

Here is an open letter that I have sent to Attorney General Cuccinelli. If he would like to respond and defend himself, I will be glad to share his response with all 14,000 of you:

Dear Attorney General Cuccinelli,

I am very disappointed in your brief filed with the Supreme Court in reference to DiGiacinto v the Rector and Visitors of George Mason University, which challenges GMU's gun ban in their library and other buildings, especially as it applies to a non-student.

Since GMU is a state entity, I understand that the Virginia Attorney General's office has to defend against this lawsuit.

As a candidate for Attorney General you said at a VCDL meeting on
December 18th, 2008 that GMU's gun ban was indefensible. (A link to
the video and a transcript are at the end of this letter.)

But what is really indefensible is the gratuitous, fear mongering aimed at gun owners in that brief.

I can understand making your argument that the GMU ban is valid based on some legal theory, since you are stuck defending GMU. The brief does some of that, BUT the brief then goes clean off the reservation into a gratuitous attack on gun owners, with a heavy does of fear
mongering and even squeezes in a Clintonesque "for the children"
emotional argument:

"Without the regulation [banning guns], the University community's safety is seriously compromised. Unquestionably, the vast majority of gun owners are law-abiding citizens. Nevertheless, a rejected student applicant could walk into the Dean of Admissions office with an openly visible sidearm to discuss why the university rejected his application. An expelled student could do the same while he met with the Dean of Students to discuss his appeal of his expulsion. A disgruntled ex-boyfriend armed with a large hunting knife mounted on his side could enter the student residences to speak to his former
girlfriend where she lived. Finally, any person who wishes to enter
Fenwick Library with a sidearm, could not only frighten students and minors, such as preschoolers, but also expose them to unnecessary risks, such as an accidental discharge"

That looks like something that Sarah Brady would write!

While you might not feel that you can win his case based on legal merits, using made up, emotional scenarios to influence the Supreme Court is unconscionable.

You ran a campaign on putting principles first. But all that fear mongering in this brief has nothing to do with principles and everything to do with winning the case AT ALL COSTS.

You were right the first time, Mr. Attorney General: principles DO matter and that brief has thrown those principles in the trash.

Finally, the argument in the brief that colleges and universities are "sensitive places" is not tenable. Truly sensitive places would be guarded like a fortress - higher education schools are not, with the public having easy access to them.

Here is the brief (the offensive language is on the bottom of page 7 and top of page 8):

http://www.virginia1774.org/RVGMUBrief.pdf

Your statement that GMU's ban is indefensible can be seen and heard by skipping forward 5 minutes and 30 seconds into this video:

Here is a transcript of your comments in the video:

"I heard the college question - you know, ***they don't have the legal authority to pass the regulations they are passing that trump what the General Assembly has said.*** Now one way to deal with that is for an individual to simply challenge it in court and say, 'Hey, I want to go walk at George Mason and this blocks me, so I have standing.' But, the problem with doing it at the legislative level is that you have got to succeed. Because, and I say, and it sounds funny, but if you don't you end up setting the reverse precedent that the courts will interpret as meaning taking the side of the university. That's the danger we have in that area."

VCDL ACTION ITEM

Let's contact the Attorney General's office and POLITELY let him know that fear mongering against gun owners is not a principle that he should be standing on. Click here to go to his web mail address:

Suggested subject: Stick to the law and do not smear gun owners!

Suggested message:

Dear Attorney General Cuccinelli,

I am very disappointed that your brief on DiGiacinto v the Rector and Visitors of George Mason University contains gratuitous fear mongering against gun owners, even going so far as to say that preschoolers would be at RISK from gun owners carrying at a public university! I would expect such a low blow from the Brady Campaign, but not an Attorney General who ran on principles and being pro-liberty.

Dear Ken C. - the current VAAG ()

Your track record as a human being is rife with instances where you opted out and took the path of least resistance, having grown up near you in Mclean, and having watching you be a total ignorant imbacile for some of your life, I expect nothing less than your usual double standard and your tripe filled triple speak. Tragically, You have not let me down, at all...this being another prime example....

You were just a little Assneck then, and look at you now, my how you have grown... your a political assneck now, congratulations!!! oh, you mean you CAN affect the rest of us... well then lets hope God has a sense of humor...

AND Ken, just because you have bad history with firearms that YOU wielded like an idiot, do NOT take it out on the rest of us...but then again, you were always that jerk that considered everyone else at the party to be just as drunk as you were... such a giant turd is hard to find...and yet, there you are...

If he still speaks with you, give your brother my best, he was the far better between the two of you.

:tinfoil:

FOR THE REST OF US:
If you, for a momment, think that you will get A.) satisfaction B.) and common sense results or C.) and intelligent approach...to anything, from Mr. Cuccinelli, PLEASE, do not hold you breath, and if, for but a momment, you believe that you see some light, its only because he is lying, and doing it profusley...which he has gotten good at, as he has been one for a LONG LONG time...

We called him Ken KOOK-a-nelli back in grade school, it was so so immature, and yet when they talk of truth from the mouths of babes...

With Ken "pot shot" Cuccinelli - Words like "air-thief" "space -taker" & "utterly worthless" come to mind... Bob chose him as he is mindless peon, and he easily, with little direction, follows the leader...but then again, my experience are based on first hand, first person interaction, albeit from many years ago, but loser then, loser now...as people just don't change that much...

Just my .02

Doesn't seem like the kind of letter that might get him to change his mind....

He won't change his mind in any case. Only if he is told to amend the brief will anything change.

He obviously isn't that kind of stand up guy as he clearly has lied to us to get elected. Who can we get to run against him?

Well that's at least one more government list you're on.

It would be nice if we could just know how many there are in total and how many you're on...just so we can keep score and see who is winning.

Sorry i was out yesterday all... had a field trip to the American History Museum, it was AWESOME!!!! a truely moving experience, and a well done walk through of our history at war, was a great thing to share with a bunch of middle schoolers, who overall were very knowledgeable and engaged... truley there is always hope in the next generation...

anyway, I also have to caveat, and throw the penalty flag on myself, I re-read my earlier post...I was nun-to-kind to Mr. Cuccinelli, and i stand by it all, don't get me wrong...but I may have meant to just burp, and ended up vomiting all over the key board...as they just sold half my company (yep , here we go again), and i had just started this god awful medication for lymes, (this doxycycline is rough stuff, feels like your guts are tied up in knots, and yet it is far better than option),,,so i may have had juu-uuust a little extra angst when i turned my flame thrower on KC...which is ok, but I may have got a little too pointed and started talking out of church...

I am refering to stuff that happened 30 years ago, it was BB guns, not firearms, to be specific, and Ken was the kind of guy that always took everything one step to far, laughing at you the entire way, as it is always funny until someone ends up crying, and with Ken around someone always ended up crying... we would take our dads thick canvas field jackets and go shoot BBguns at each other, in the park area in the franklin forest area of mclean, we had eye protection etc, and you had to shoot soemone above ther waist, and the BB's would bounce off the jackets, no head shots... this was right by Kens house (bottom of dead man's hill) well, he came out, had to play, long story short, someone doesn't keep the gentlemens rules in effect, someone gets it in the butt, has to have a BB removed by a doc, parents are called, fun over... all because soemone doesn't play well with others...the situation with his brother was after that, involving bottle rockets, and thier idiot application, taken to far as well...and i was not around when that occured, but knew all the players invovled, right after that, he was transfered to a private school and i never saw him close up again.

OK, so looking a back on it, I should have paraphased all that and said, "ken and I do not see eye to eye as human beings, and his actions described here do not suprise me as this is his SOP" and left it at that...
