A little diferent CC question

Post by ccbob »

I know that we may not CC in a liquor-by-the-drink restaurant until July. However, what if it is not open and serving alcohol? I'm thinking of a place that only serves for special parties and not on a daily basis.
Your best defense is a smart defense. Be prepared.

First, you have to determine if the establishment fits the legal definition of a restaurant as defined in COV4.1-100

Then you can read COV18.2-308 J3, which covers the actual law prohibiting concealed carry in a restaurant.

To go along with what OakRidgeStars said, it matters what kind of ABC license the establishment has - you can either ask them, or look it up on the ABC website.

Exactly. This is extra hairy because there are some smaller restaurants that I've been to that have the license, but don't actually serve alcohol at all--it's still illegal to carry there.

It's so much easier in texas. They have to have the legal sign posted to keep you from carrying (except on federal territory). I was in Austin a few months ago and none of the bars had the sign posted so I kept my gun with me the whole time (didn't drink of course).
