No, he was only arrested. What hasn't been determined in the press noise is whether he was actually indicted. If he was under indictment, the check should have failed.

I don't know that indictments are put into NICS. I think he just lied on the 4473 when it asked that question.
BTW, SCOTUS has ruled it's against a criminal's 5th Amendment right against self-incrimination to have to answer the 4473 honestly.
Either way, the background check failed.
