I moved last year and decided to have my address changed on my permit as it had expired a few days before and I wanted it to match my DL. I filled the paperwork out and was informed by the deputy in charge that I had to have my picture taken to accompany my application. Sussex county was the district. I cant find anything on this website or law.lis.virgingia.gov saying that I had to do that. The deputy assured me that I would not be granted the permit if I refused... I'm now starting to think he misrepresented the law

Pretty sure the application doesn't say anything about requiring a photograph.§ 18.2-308.02. Application for a concealed handgun permit; Virginia resident or domiciliary.
A. Any person 21 years of age or older may apply in writing to the clerk of the circuit court of the county or city in which he resides, or if he is a member of the United States armed forces, the county or city in which he is domiciled, for a five-year permit to carry a concealed handgun. There shall be no requirement regarding the length of time an applicant has been a resident or domiciliary of the county or city. The application shall be made under oath before a notary or other person qualified to take oaths and shall be made only on a form prescribed by the Department of State Police, in consultation with the Supreme Court, requiring only that information necessary to determine eligibility for the permit. No information or documentation other than that which is allowed on the application in accordance with this section may be requested or required by the clerk or the court.

Seems like an odd request to me. All they have to do is pull your DL info & they have a pic. I presume they pull your DL info as part of the process anyways.

Before I even clicked on this post, I thought... "Sounds like Sussex County". Yeah, not very surprised.
As suggested above, send an email to the VCDL and let them look into this. I doubt that you're the only one they've pulled this on.

That is crap. We need some teeth in the law as the clerks seem to feel free to disobey it at will. But with a bloomyboy in the gov mansion fat chance of that.

I have to follow the letter of the law, and I expect "them" to do also... VCDL please.
It may seam trivial, but when someone steps out of bounds they MUST be called on it. Period.
