Man, and I figured this wouldnt really come to va out of fear of being shot.
It pissed me of more that they were so arrogant they knew she was taking pics and kept beating on him.
I told my wife if this happens to me, while I will try as long as I'm able to pull my gun or knife, don't even give them the benefit of a warning. Just empty a mag in them without saying a word.
This is getting out of control with these dirty thug coward monkeys.
I have no qualms about killing one of these punk motherfcukers if I'm in that situation... they surely don't.

Incident made the Drudge Report today. Apparently the Daily Progress shut down their comments section on the article because too many people said the right things about the animals who did it.
I would not hesitate to defend myself and family in such a situation with decisive force.
I also wonder why didn't anyone watching intervene? Oh yeah, C'ville is the Sheepville of central Virginia.

That being said someone getting their head kicked or punched in against a hard surface like pavement would be in grave risk of death or disability.
Dunno how that works out with VA common law and using lethal force to defend a third party.

As far as the code and common law, it is my opion the deadly force would be justified in defending a stranger in that case.
I would not skip a beat in defending a stranger if I witnessed an unpravoked attack. The problem is, if you don't see how it started, why, or who the agressor is, I would try to break it up an sort it out. I would hate to mistakenly shoot a vic because he is getting the upper hand on an attacker.

This is true. One would, indeed, want to know who started what, and why, etc. Seems wise and prudent to me.
I really hate that I find myself questioning whether or not I am legally able to defend the innocent in such fashion.

Since we have a VCDL guy in the Police, and Militia committee in the G/A... why don't we see about passing a law that excludes the attackers/families from suing those who use force in self-defense, or defense of others?
On top of that, why don't we see about passing a state law protecting those who use force in self-defense or defense of others in a "stand your ground" policy.

If I see something like this where three black guys, dressed like they were, are beating the crap out of a single white guy I'm going with my instincts... if I was wrong then my bad. I mean profiling was only called politically incorrect because it worked.
Not saying I would shoot at that point just in case, but normally in situations like this one, when the aggressor sees a gun pointed at them they will take off.

...or if it's a group of aggressors, they are generally quite demoralized when one of them is bleeding out from one or more holes that are anywhere from a quarter to a half inch in diameter.

vaeevictiss, I can see your point. I don't know any one guy crazy or stupid enough to randomly attack a group of people regardless of anyone's race. But, what if in your situation, the white guys turned out to be a drug addict hopped up on coke and PCP, thinks the 3 black guys are "out to get him" and freaks out and attacks them?
Granted... not likely, but I would still have trouble knowing I killed 1 to 3 innocent people once the smoke clears. Not to mention, I may go to jail.

So, SHMIV / All, here is my crazy story I mentioned.
Had left Red Robin in Hoodbridge at Potomac Mills Mall after having dinner with the family. I was heading to route 1, so I decided to drive around the back side of the mall where the loading docks and employee parking. The idea was to get on Opitz Blvd by cutting through the mall property so I can avoid some red lights.
There are no street lights back there. As we drove by employee parking, my headlights lit up the parking lot. My wife says "you need to go back, it looks like two guys attacking a girl over there."
I turn around and pull into the lot, hit my bright off-road lights on the roof of my Jeep and see a fight going on. For those interested... all three were the same race.
What I see is, a small guy on his back with a larger guy (maybe double the little guys size) pinning the little guy to the ground. The female is standing over these two guys punching and kicking the big guy on top.
I hop out of the truck and say 'hey, break it up or I'm calling the cops!" The big guy looks back over his shoulder and says "man... call the cops, these guys jumped me. I've been stabbed." Just then, I see the big guy not only has the little guy pinned, but he is holding the little guy's arm down. The little guy had a big knife in his hand.
I go back to the truck, tell my wife to call the cops for a stabbing vic. I go back to the people fighting, they broke it up. The guy and girl start to get in a car to drive away. I try to stop them and the vic says ""let em' gone, I know who they are. Its my ex-girl friend." Not wanting to get stabbed or run over, I let them go.
We get the plate and car description for the police. The vic bleeds out enough that he passes out and almost dies before the cops even show up. If I didn't stop. The vic would have been killed.
At this point, I started the interaction thinking the girl was the vic. Mid-way I thought the little guy was the vic, turns out the big guy... last person I thought to be, was the vic. However, I still have no idea who was right, wrong instigator or true victim.
I go to court to testify before a Grand Jury about a year later and I finally see the whole story...
The stabbing vic and the girl were dating. They both worked at a jewelry manufacturer. The girl delt with precious metals and he was security. He caught her stealing and did the right thing, turning her in.
Criminal ex-girl friend and new boy friend bump into the stabbing vic at the mall one night as he was on the way in and they were on the way out. They got weapons, found the vic's car and ambushed him when he came out of the mall.
So, here is my question for those who want to really think... If I went with my instinct and shot the first person I thought was the aggressor, I would have killed a good and innocent man. As an on-looker trying to save a life, don't you think it's best to take a second or two from a safe distance and try to make sure less than lethal force is enough and the right person is ID's as the perpetrator?
I took the time to make sure the fight stopped, the right people went to prison, the good guy lived and most importantly, I didn't have to kill anyone... especially the wrong anyone.
Yes, don't be a victim, but don't just start blasting away because of initial appearances.

That is a good eye opener. But that's what I was saying above that I probably wouldn't shoot. Most defensive gun incidents do end without a shot ever being fired, which is odd because I always thought legally, if you draw it IS to shoot because you don't draw unless you feel your life in immediate danger.

I have mentioned my thoughts on that before. I always thought that if an assailant was approaching me with a weapon or if a group is approaching me who display the body or vocal language evident that they plan on doing me harm, I will draw my weapon to defend myself, ready and planing to use lethal force.vaeevictiss wrote:That is a good eye opener. Well, what if the personal or people plainly see I am drawing my weapon and stop dead in their tracks... they are no longer a threat to my life... so I don't fire. Instead I keep them covered until they run away, the police arrive or if the issue continues to escalate, I protect myself.
That is really the only practical explanation I can think of. Likely not the only one, but the only one I can think of.

Exactly! That's the beauty of it guys. I never drew or presented a weapon nor threatened to use a weapon. Truth is, at the time I was totally unarmed. Back then I didn't even own a pistol. I only owned a long gun. So presenting a weapon never even played into it.
Now... that being said, I got an earful from the police. They were thankful that I was able to save this guys life, but really drove home the point that I could have easily have been another victim.
That was the day I decided I was going to carry everyday. I am not the kind of person to turn a blind-eye when my brothers and/or sisters need help, but I sure as heck would rather not be a victim in the process.

Sure, you could have been another victim. No one ever said that doing that right thing was easy, convenient, or safe. In fact, it's almost never easy or convenient, and often unsafe.
