open carry question

Open Carry and Concealed Carry. Where did you carry today?

If I was carrying concealed with an IWB holster, but then tucked the bottom of my shirt behind the grip of the gun now exposing most of the grip, would that now be considered open carry or still concealed since most of the gun is still hidden underneath the waistline of my pants?

Not a lawyer, but iirc, there was some court commotion where someone's shirt accidentally covered a handgun for a non-CHP citizen and was arrested for CC without a permit. The Judge supposedly asked how the Officer knew the defendant was carrying concealed and the Oficer stated he saw it. Judge supppsedly dismissed it because if it was seen, it was being OC'd. Have't looked to see if it's true, but it makes for a neat story.

I open carry with a DeSantes Scorpion and XD all the time. The weapon does NOT have to be hanging out in the open, to be open carry.
