Verbal threat - deadly force? They did not mention the brandishing of a weapon....

Woman says robber threatened her baby

Published: Apr 24, 2013, 10:14 AM
A woman reported a robbery last week at a North Stafford Walmart in which the assailant threatened to kill her baby, according to the Stafford Sheriff’s Office. The incident happened last Wednesday night at the Walmart on State Route 610 in Garrisonville, according to information released Monday by Sheriff’s Office spokesman Bill Kennedy. He said the woman reported the robbery the day after it happened. The woman told authorities that she had returned to her car at about 11:30 p.m. with her baby in a store cart when a man approached her. He told her to give him her wallet, Kennedy said. When she refused, the man threatened to kill the child if she didn’t give him her wallet. The woman handed over the wallet to the assailant, who went through it and left, tossing the wallet aside, Kennedy said. He did not say whether the man made off with anything of value. The woman described the robber as a black man standing about 6 feet tall. He was wearing blue shorts and a navy-blue hoodie, which covered his face, according to Kennedy.Anyone with information is asked to call Crime Solvers at 540/659-2020.

I am suspicious of that "day after" report

Still it begs the question. Faced with this, I'm not sure what I would do? If the assailant is in close proximity it could be valid for lethal force... But without a display of a weapon?? And then it's possibly a dead person with no weapon and your statement....

I'm sure there is more to the story then what we know at this point in time.
What race was the victim?

Tough call with no reported weapon. Given what happened in Brunswick, GA a while back though...

If you have to ask then it wasn't. But she could of chose a non lethal area to shoot so as to neutralize but not kill the assailent such as the leg or shoulder.

If a perp is robbing me and makes a verbal threat to my family, they will get to see my carry weapon, regardless if they display a weapon. That is why it pays to be aware of tour surroundings and strange people. With that said, this story sounds fishy.

Depends on if a weapon is displayed. If there isn't one, and I reach back to draw my Carry? And they're not running?

Yeah, somebody who makes threats is gonna be coming up room temperature quick.

He has made verbal threats. When a person makes threats believe them.

He is in close proximity to my and mine....just by the fact tht they are small and his threat is enough to make me back up quick and tell his to leave in mot certain terms. To a child a punch can be lethal.....not going to give him that chance.

Then I am calling the cops. He will escalate to serious violence soon.

As mamabear noted, small children are particularly vulnerable, whether the bad guy has a gun/weapon or not. Even hands can hurt a wee one.
Assuming all is as reported...
He would see my CC gun. A strongarm crime by someone willing and able to do serious bodily harm, or more, is a situation where use of deadly force is is defensible.

Since a baby was just murdered by a black dude I'd be on edge yet if I start shooting I would be Zimmerman'd for defending my kids.

Not trying to be accusatory, as I may be missing something in this story, but what does the victim's race have to do with it?

Anyway, how I handled it would not have depended on my legal standing. I'll deal with that aspect once my child and I are safe. If I was threatened and felt I could draw quickly/covertly enough without putting my child in danger, I would have pulled the weapon. I wouldn't fire unless the situation escalated, but the guy would have been running away or pleading for me not to shoot while I called the cops. Probably not a bad idea to make some noise in the parking lot too, since even at that hour, Walmart is never empty.

I assume the cops will be pulling video surveillance since Walmarts always have dozens of cameras aimed at the parking lots.

Wow...I've been to this Walmart.

My threat triangle would have closed at the threat of killing my child.

I would have smoked him the moment he approached me in a parking lot and threatened my child. I'm not going to give somebody the chance to show me if they're serious about something like that.

Interesting...is a weapon required on the part of the assailant in order to use deadly force?
