In VA you can create a trust yourself by simple notary republic. However, you must research what you are doing as a general template may not meet your needs or be legal in your state. VA is pretty easy though. Realize that there are documents that must be created/altered every time you add something to the trust for another transfer or move (assignment of property/schedules/cert of trust). Some of it depends on how the NFA item was purchased, but you should make sure you understand what your lawyer will charge to update them or if you do it yourself. I don't have experience with any of the lawyers offering these trusts.

I have been thinking about it and yesterday at the gun show they had a sign up to recieve information. Of course I signed up and here is the info that I recieved in an email incase anyone is interested in costs and such:

Vern, thank you for your interest in our services.

Our law firm serves gun owners exclusively, and our Arsenal Gun Trust™ has earned a reputation for prioritizing gun owners’ concerns, including: safety, gun law compliance, privacy, security, care for loved ones, and ease of use. Whether you’re interested in owning National Firearms Act (“NFA”) firearms (silencers, SBR’s, full auto etc.), or you’re concerned about who inherits your firearms, the Arsenal Gun Trust™ can help.

We provide you an Arsenal Gun Trust™ prepared specifically for you based on our personal consultation and a highly interactive design process. Clients find this experience a valuable opportunity to become knowledgeable about NFA issues as well as inheritance.

Overall the Arsenal Gun Trust™ offers three major benefits:

1. A Legal Compliance Solution: Your Trust will comply with current Bureau of Alcohol, Tobacco, Firearms, and Explosives (“BATFE”) requirements, and you will avoid the need to submit fingerprints, mug shot, or your local Chief Law Enforcement Officer's signature for BATFE Forms 1 or 4.

2. A Risk Management System: Others named in your Trust may legally possess your NFA firearms—even outside your presence. Without the Trust, a spouse could not have access to your gun safe, a brother could not borrow an SBR, or a father could not store the NFA arms of his son who is in the military overseas.

3. An Estate Plan: A Trust is the only way to inherit outside the court system. Therefore property in your Trust may be inherited without court costs, lawyers’ fees, and a public court record. Additionally, our Trust documents will provide your loved ones guidance for inheriting and transferring your guns safely and legally.

In the future, you can easily make changes to your Arsenal Gun Trust™, including the people or property in it, because it is a ‘revocable’ or ‘living’ trust. Also, your Trust will remain valid if you relocate to another state.

Our process begins with your completion of the attached 3-page questionnaire, which you may return by email or fax. Next we’ll conduct our phone consultation, during which you may provide payment details using any major credit card.

Following our phone consultation, we’ll prepare all the Trust documents for you in a week or less. Our complete package consists of five documents, including our detailed 20-page-long user's guide. That guide addresses many of the issues clients and their loved ones may encounter in the future, such as interstate travel with NFA guns, completion of BATFE paperwork, whether a trust checking account is necessary, and more. Following your death or incapacitation, your loved ones will be grateful to have this guidance from your Trust.

Our fee for creating your complete Arsenal Gun Trust™ is $395. This Trust will terminate when your Trust Property is transferred to the beneficiaries you have chosen to inherit.

Alternatively we can design your Arsenal Gun Trust™ to be perpetual. Rather than transferring your firearms to beneficiaries at your death, your firearms could remain in your Trust and your successive trustees and beneficiaries could be named to continue your trust. The fee for a perpetual Arsenal Gun Trust™ is $795.

We will deliver your Trust by email. Once you sign the documents before a notary public, you may immediately begin using your Arsenal Gun Trust™. For an extra fee we can deliver the documents in hard copy in our ‘Ready-to-Execute’ package.

To receive news related to the Arsenal Gun Trust™, its benefits, and practical tips for its use, we welcome you to join us on Facebook and follow us on Twitter. You may also sign up for our newsletter at our homepage.

Finally, when deciding whether to create a Trust, please beware that only a licensed attorney may help you. Others, even a gun dealer or friend, commit a crime by handling such matters without a license, and their liability insurance won’t compensate you for any mistake they make.

Thank you in advance for completing the attached questionnaire. Please note, you should save a copy of your completed questionnaire with your data and then email it as an attachment or fax it to 877-518-5388. We accept questionnaires only by email or fax. We look forward to speaking with you soon.

Best wishes,

Matthew J. Bergstrom, Esq.
