You raise an interesting queation. Legally there is a difference between residency and domicile (your friend resides in Va but is domiciled in the other state. Another example: Barack Obama is a resident of DC, but is domiciled in Illinois). The distinction is important in litigation (e.g., federal jurisdiction diversity of citizenship, and family court when the parents are living separate in other states) but is often glossed over in other contexts which is confusing enough to lawyers, never mind laypersons. I think in this situation, residence means domicile , based on the proof one must furnish to prove it establishing intent. There are a bunch of policy reasons here for making it domicile rather than just residency, too but i wont get into that. Al this said, if I were you I would follow the laws regarding sale to another person to the letter. Or if you want, ask your local police station (unless VA has a firearm control board, then you should contact them) to answer the question for you, and get their answer in writing. This should immunize you to any adverse legal consequences, much more than paying some lawyer $200 to get the same answer I just gave you.

I have no idea. I just said that because, if it exists in a state (and it obviously exists at the federal level) asking them for what the law means and following their interpretation basically immunizes you from any kind of adverse legal action, especially criminal penalties or civil fines. What agency is this federal firearm control board under? Are you actually referring to the ATF?
Nothing immunizes you from anything. Law enforcement makes arrests. It does not provide any binding decision authority. Heck, even with the IRS, you have to pay them for a written binding decision on tax law. Talkimg with their phpnestaff only gives you an opinion.
