The official Obamacare SCOTUS decision prediction thread

Post by OakRidgeStars »

For those of you who have been busy wallpapering your doomsday bunker for the past two weeks, the Supremes are due to release their decision tomorrow morning on the fate of Obamacare. The general consensus is that it will be struck down, or at least the individual mandate requirement will be.

So, what's your prediction?. One thing is for sure, if Obamacare goes to the death panel then the past 3 1/2 years of Emperor Obama's rule have been one colossal waste of time and money.

Sound off.

In part or in whole.... I believe it is going down in some way, shape or form. In some ways I feel like the SCOTUS fears a grassroots outcry.

What I think will happen?

mandate goes due to the ideological makeu of the SC. rest stays. interestingly a few of the larger health insurance co's said they're keeping the provisions anyway.

What I think should happen?

It falls under interstate commerce and is technically constitional. Many health insurance customers do not live in the state where their insurer cashes the premium checks. Looong gone are the days of the house-calling country doctor and healthcare has really changed alot.

I dislike the mandate er, mandate I buy insurance from a private for profit insurance company. Thanks again lobbyists.

SCOTUS votes 6 - 3 to uphold the individual mandate.

"SUPREME COURT RULES:
Mandate survives as a tax...
Chief Justice Roberts joins the left of the Court...
The Medicaid provision is limited but not invalidated...
'Congress had the power to impose the exaction in Section 5000A under the taxing power, and that Section 5000A need not be read to do more than impose a tax. This is sufficient to sustain it."

So much for defeating Obama to "protect" the SC from evil liberals. Bush appointee Roberts saved Obamacare (5-4), while liberal Kennedy went against it.

That settles that then I guess.

Well, I guess our small company will get busy figuring how many employees we can eliminate by contracting out production and otherwise just getting leaner and stretching further. It may come to accepting one of those buyout offers; which will result in the loss of half to two-thirds of the jobs here; because they'll shut down manufacturing here completely if they buy us out.

Didn't want to do that, but it is now clear that we have no choice.

Thanks, liberals.

America's people are now completely screwed. This year's election is now the most important in history. If you have friends who don't vote, talk to them until they do. I don't want to consider the alternative to peaceful resolution via the ballot box.

I want to know the backstory of how Roberts, who sold himself as a constitutional originalist, sided with the libtards on both this and Arizona.

The worst part is that Obama and his fascists will now spike the ball, claiming that the SCOTUS has affirmed their position as being in the "mainstream" of our political culture and validating their demand for another four years on the road to serfdom.

Seven decades of "Progressive" domination of the SCOTUS have taken us to the point where the original Constitution means nothing any more. There are too many precedents being cited that support the perverted, statist interpretation of it.

The shining city on the hill is done. All we can do is hope to slow the decent and preserve what little is left of the light of freedom.

If you can now be taxed for non-behavior, you can be taxed to poverty and out of existence. All congress has to do now is say something is not a tax all through the passage of a bill and then once it is challenged at the supreme court argue that a penalty is a tax. We can now be taxed for not eating bananas, not going to a gym, not buying green energy things, not buying a certain brand of car....the sky is the limit. Thanks Roberts....you are no longer considered a friend to liberty.

And when you get a huge medical bill you cannot stop the payment for it and contest. They will simply take the money (whatever they consider, like 5K for a root canal) directly from your bank account.

I haven't read much about this except one-sentence blurbs, but I will say this much:
I suspect Roberts would tell you he is being true to conservative values by not practicing judicial activitism. If he felt the mandate was constutional, it would have been interventionist activism to fabricate a basis to strike down the law just because it was the dumbest thing Congress ever did. Judges are not supposed to legislate - even when Congress abdicates that function through inaction and dysfunction. P!ss poor legislation is supposd to be cured by voting out legislators; not by having jurists exceed their authority.

The bill did not call this a tax....how does Robert (and the other justices) get to redefine a "fine" into a "tax". If that is not judicial activism I don't know what is. He is creating something that was not there before and putting it in. He is not judging the law, he is changing the law (legislating). We have not only been the victims of a bad law, but a victim of fraud as well.

Even the White House website says that the individual mandate is not a tax. I bet that gets changed real soon.

I won't, because she taught me that by beating the CRAP out of me when I argued with her.
