Virginia background checks for gun sales challenged
From The Virginian-Pilot
RICHMOND - Virginia's criminal background check system for firearm purchases, the first of its kind in the nation, is being targeted for elimination.
Gun-rights advocates have lobbied Gov. Bob McDonnell to scrap the program, arguing that it is redundant because a federal background check system can replace it.
Gun-control groups say doing so would take a valuable law enforcement tool away from Virginia State Police and undermine state gun laws.
Efforts to cancel the state's 22-year-old background check system, known as the Virginia Firearms Transaction Program, could be debated in the upcoming General Assembly session. Republicans will control state government for the first time since 2001 and a determined push to loosen state gun laws is expected.

I have to be honest i do like the state's stricter mental health check but it does seems foolish to have two systems doing basically the same thing

I think it should be the other way around Keep the Virginia Background check and do away with the Federal one. This is a Stae issue and the states should be the ones that do the check. I do agree that one of them should go and IMHO I think that the Federal should be the one to hit the door.

If it faster than sure. I ha e a common name so i always get delayed when having a check run. Usally only a couple of hours. But the last few times have been ridiculous.
I went to the Dale City VFW show Saturday morning and put an application in around 11:00. Here it is Sunday night at 20:00 and still not even looked at yet. So much for the great "instant" background check.
I think that if you have a valid CHP there should be a way to speed things up. Obviously i have passed it at least once to get my CHP. There should be some sort of link between me, my CHP, and my "record" that would negate my common name.
Sorry, irritated rant.

Bought one last week took 3 days. Bought another over the weekend and it took 4 days.

Mine also took 4 days on the last one i bought. Which turned into 2 weeks since the dealer was not local and had to wait for them to come back to the area for another show so i could actually pick up my purchase.
I am now very reluctant to buy at the shows anymore since most of the dealers are not local and the few local shops in this area are way over priced.

Re: Virginia background checks for gun sales challenged
I'd say they can keep what ever check system they want, but change the law in another way.
IMO if the dealer was willing to start the transaction by submitting the BC paperwork then they had an intent of completing the sale. Therefore, After 3 working days the dealer MUST complete the transfer.
Right now its an option for the dealer to complete the sale after an extended delay. But I know of NONE that will do so because of the liability it creates on them because the customer might be a prohibited person. For the dealers benefit, extend immunity from liability for improper transfer.
Its a shame that the automated systems can't use a unique ID number to AUTOMATICALLY disambiguate me from a same/similarly named person.

The unique ID number is supposed to be my social security number. Heck there is a file number on the VA permit. How about using that.

And I'm going to double down on that. This is a states' rights issue. There will be lots of trouble with "federalized" gun laws and regulations; that includes a nationwide CCP.dorminWS wrote:>>>>>>>>>>>>>>>>>>>>>>>>>>>>Taggure wrote:I think it should be the other way around Keep the Virginia Background check and do away with the Federal one. Re: Virginia background checks for gun sales challenged
I agree on the MUST complete if it takes over X amount of days to get a response....Social Security numbers have no place as Unique Identifiers on ANY document //// Random issuance of a record number at the sale would be more proper

Re: Virginia background checks for gun sales challenged
Good. I am on day 3 of being delayed for an AR stripped lower. I have a unique name, a clean record, and a CHP - this is an unreasonable waiting period. I'm fine with the additional VA checks, if they can occur in a few minutes like the VSP website claims.

The whole point of this thread is that VA has a background check that is in addition to the Federal variant.

Re: Virginia background checks for gun sales challenged
Delays have been coming much more often and take much longer to clear I have noticed. To the small shop owner a gun sale is a really big deal. Not because of the high profit, (ain't one), but because of the recovered capital that may be used to pay the light bill. When a delay is received after spending time showing a customer a particular firearm and explaining the attributes of same, a delay may mean a lost sale. I would like to know if anyone from the FTC can explain what the heck is going on.

Ever think that they may be delaying the checks on purpose???
