waiting period for BC

It's been awhile since I have posted here but I always seem to get an answer, I have lived in Virginia for 10 years now and have purchased several firearms (pistols, rifles and shotguns) with the pistols as everybody knows there is a required background check, for me the wait for it to be OK'd varies from a couple hours to several days the VSP website says it is practically instantaneous or about 2 minutes or so to get okayed... well it's never been that quick but some of my gun owner buddies say it usually only takes an hour or less. I work for the federal government (GSA) so I have had my background checked at least 5 times since I have worked for them. I have no police record hell I haven't had a traffic ticket in 8 years and I paid that within 2 weeks so I was wondering why does it take so long for my BC to clear?

The more common the name the longer it takes. Also someone with your name may have a criminal history.

If your name doesn't go through on the first pass, the record has to be checked by an actual person. Going through the online check can mean a long wait for one of those real people to get to your file and sort out whatever the issue may be. Calling it in can result in the clerk on the other end doing the legwork while you wait, but not always.

About the only advice is to ask your dealer to call in the check instead of doing the online submission. May work, may not, your options are limited either way.

You can also lobby the legislature to either give the VSP more money to hire more people for the VFTP, or to kill the VFTP entirely and go to the federal system which is usually much faster.

I too have been waiting since Friday ( Day5 ) I just got my CHP, and also purchased a handgun a little over a month ago, also bought a shotgun about 3 months ago so my check has been ran at least 3 times the last 6 months. You would think you wouldn't have to have it ran this often in this short of time? WUWT

If you fill out the paperwork and while you are waiting see something else you want... if the paper work has already been submitted to the state, you have to do a whole new set of forms.

And the REAL joy is I've see people come back approved on one set of forms, and delayed on the other.

Well, I guess as long as it hasn't been denied, I'm still in pretty good shape huh? This firearm was an online purchase from a impact guns I don't think I'll be doing this again. But I don't believe it's any problem with them though.

Talking to a dealer at a show the other weekend the VSP have been horribly behind since black friday. My BC is usally delayed a couple of hours for having a common name but it took four days last week.

Suspicions are budget cuts and not enought people to keep up with the demand.

It does suck because we are suposed to have a better system in place plus i hate waiting. When i am ready to purchase i want to walk ou the door with it.

I watched the salesman hit the Enter key on my last BC and he immediately went to the "approved" page and my name was at the top... less than, say, 5 seconds. If the approval is going to go through automatically, it happens at the speed of transmission, to and from. My full name is a fairly unique one, thankfully.

Technically by Virginia Law:

Police shall, as soon as possible but in no event later than the end of the dealer's next business day, inform the requesting dealer if its records indicate the buyer or transferee is prohibited from possessing or transporting a firearm by state or federal law. A dealer who fulfills the requirements of subdivision 1 of this subsection and is told by the State Police that a response will not be available by the end of the dealer's next business day may immediately complete the sale or transfer and shall not be deemed in violation of this section with respect to such sale or transfer.

So after the following business day it should be yours.


I'm having trouble with this too right now. I'm tried to buy a rifle today. Delayed as usuall. (Around noon) And still have not heard back. I have a security clearance.

But my father in law (who is from WV) is visiting. He buys one today and instantly cleared.
He's got a clearance and a federal explosive liscence.

I think it all comes down to common name and how lazy the VSP is being. I beleive there should be a way to call them or report them if they take to long.

I mean, what do the VSP expect people to do when they drive an hour to a gun show and buy a gun from a dealer that drove 4 hours from the opposite direction. And they "can't get to it" till 5 days later. Drive 5 hours to pick up your gun?

It seams to me like it's only hurting these business that are trying to get buy. I mean I could spend money locally on a gun, but shouldm't I have a right to buy within a reasonable time from a dealer that I like and not one that treats you like crap like most of the NOVA (ripoff) dealers I have been to.

I understand the background check. But something has to be done. If you are legal to buy, you shouldn't have to jump through hurdles to get a approved. I've got a VA concealed permit, whouldn't that make me legal to own a gun? And really I think the name common name thing is BS. I give them my social security number. No one else has the same number as me as far as I know. I've bought several guns in VA. All a pain. When I go home to West Virginia, Approved instantly. Why is that?

Absolutely. But between state law and federal law, things are tied up. All of the laws are badly outdated and are in need of either updating or scrapping.

When I go home to West Virginia, Approved instantly. Why is that?

Thank Governor Doug and the Democrats who created the Virginia Firearms Transaction Program (to administer their one-handgun-per-month law). If we were a direct NICS state, like West Virginia, this situation wouldn't exist.

It's kinda funny. I believe this only encourages more face to face sales for used guns which have no way to really verify the person unless they have a CC.

Which by they way is a joke. A CC that is printed on a piece of paper, really? Even in WV the CC is a nice card with a color picture and seal just like a DL. But that's probably a whole nother rant
