a few weeks ago I was arrested while carring.

I had just paid for my two beers at the Brass Lantern off of Buckroe, I sipped off of my second beer then I went to the bathroom, upon returnning from the bathroom I noticed the beer I just bought had been removed the bar tender had moved towards the door of the bar to talk with the patrons at the other end by the exit door, I went down by her and asked what happen to my beer? she then told me I was cutt off because she saw I had a gun on my hip, at that moment I had three patrons come at me one was striking me in the face the other two were trying to get at my Walther PPS .40 S/W, while I knew my PPS was chambered I quickly covered my hollster and ejected my clip, they were able to get one shot off before my PPS locked open, due to no clip, I was arrested for drinking in public, Brandishing a firearm, and Mis handleing a firearm. My bail was $2500.00 I have a concealed firearm permit, I hired Ron Smith to reprsent me in court for $1000.00 all were misdemeaner charges, how do I fight these charges?

Welcome to the board. And please do not take offense to what I am about to say.
But Shut up. Do not speak about the incident with anyone except your lawyer. This is for your protection. Prosecutors love to take things Defendants say out of context to make them look as bad as possible. I do not know Ron Smith, but I would make sure that he has had prior experience with criminal charges that involve firearms. There are a lot of nuances to laws concerning firearms. If Mr. Smith does not have that experience I would make sure to at least consult with attorneys from the list that Jay pointed out to you above. But again, save your attorney a lot of hassle and don't discuss the case with anyone, that includes friends, family and even gun friendly message boards like these until after the verdict is in on the case.

I have strong opinions on this matter. I assume, since you've retained Ron Smith, that you're in Fairfax. I don't have anything to say about that decision, other than to observe that Smith is a decent and well-meaning guy; and he does have a sense of justice. Others have told you to keep your big mouth shut, and that's good advice ("KYBMS").

But I would strongly argue that you should not accept a plea agreement, and that you should plead not-guilty and go to trial. Make sure Smith knows that's your intention long before the trial date, so that he'll have time to adequately prepare for trial. And do not buckle under to the pressure to accept a plea agreement (and there will be pressure, you'll have a limited amount of time in which to make a decision, and your options will probably not be made clear to you at the time). If, by some mystery, you should be found guilty at trial in the GDC, note your appeal immediately in writing in the clerk's office, and be prepared to post a bond to have your case transferred to the Circuit Court.

For future reference, although OC and drinking a beer is technically legal, it's probably not a good idea for several reasons.

You’re an IDIOT and you deserve to get what’s coming…asshats like you make all of us look bad. Yes it’s technically legal to drink while open carrying, but who in their right mind would do that. There is nothing you can say to justify drinking and carrying…NOTHING. If you aren’t responsible enough to carry then you don’t deserve to even be able to have a gun.

Three people just start punching an armed man in the face for no discernible reason? I doubt that. Methinks you're not telling the whole story.

I've never handled a PPS, so I don't really know... but.... all of my pistols lock open on an empty magazine, no on NO magazine. Does the PPS lock open on NO mag?

A number of things are not adding up in this story. Either something has been left out, the OP explained it wrong, or it is total....

Why was he attacked for no apparent reason, why did they go for his gun, this sounds like a bar I would not go in to because it sounds like you NEED to be armed to go in to. Slide locked open on NO mag in? This is just the start

Silly rabbit...everybody knows that the slide on a pistol does not lock unless there is an empty mag present and locked in the well...

Let's see.. I'm almost 50 years old and I have been jumped by 3 guys in a bar for no reason how many times????

Oh yeah.. ZERO!

Probably a gay biker bar on all you can drink lesbian night, with the straight Chippendale's performing, and a bunch of Honda riders came in too, the he bent over to pick up a peanut.... :wave:

My google-fu was unable to locate any reports of such an incident in Hampton, VA (Buckroe Beach) since the beginning of this year.

Prolly not the cleanest place to eat or imbibe.

Folks who live on the Penisula might chime in here - when I lived in Hampton Roads many years ago, Buckroe was not a place to take family or a date. If that is still true one wonders why go solo into a bar while carrying?
