SBR legal in VA???

Ok, I'm sure this has been asked her before, but I could not find it anywhere.

Would a SBR with a 11.5 in barrel be legal in Virginia. I only ask because my local commonwealth attorney told me that it would be illegal to own in VA. and therefore he would not sign my ATF Form 1.

The only reference I have seen in VA code is that made to "sawed-off" rifles which can not be less then 16".

If the rifle is in compliance with federal law, it should be legal in VA...
ยง 18.2-303.1. What article does not prohibit.
Nothing contained in this article shall prohibit or interfere with the possession of a "sawed-off" shotgun or "sawed-off" rifle for scientific purposes, the possession of a "sawed-off" shotgun or "sawed-off" rifle possessed in compliance with federal law or the possession of a "sawed-off" shotgun or "sawed-off" rifle not usable as a firing weapon and possessed as a curiosity, ornament, or keepsake.

Yes, SBR's are legal in VA as referenced above. If they were not, the ATF would not approve them anyway. I have two and I know many other people that have them as well.
Go trust if you can't get a signature.

Thats a REAL shame that the commonwealth attorney doesn't know the law in the state he practices in.

SBR's are perfectly legal in VA.

IMO form a trust and bypass the whole CELO sign off BS.

Honestly? Never ASK them the law, TAKE them the law, and then say "Sign here please!"

Because at that point? What can he say? "No, I don't agree with the law." Ain't his job. Find the Chief of Police, he can sign it as well.

Did we every find out if a MAGISTRATE is legal for signing off on ATF forms?

Building a 11.5" 5.56 SBR. Well, hopefully still waiting on ATF, figure I will hear from them around the end of August.

ATF cashed the check I sent. Now let's see how long it takes them to get my paperwork back too me. So far so good.

whoo hoo, that means I should be less than a month away.... if all goes well.

I tell ya, it sucks a lot waiting for the first one, but it only sucks a little less waiting for subsequent ones.

I've heard there is no real speed increase for having been in the system previously.

Each transfer is an independent event. You are not the only thing being examined.
