Let me reinterpret...the 4th Amendment and Common Law are incompatible with a police state, therefore they must go.

Did I get it about right?

I think you missed the most crucial point of that case...
The Supreme Court ruled 8 to 1 on a Kentucky case in which police broke into an apartment after smelling marijuana and hearing sounds suggesting evidence was being destroyed.
The police were high.
