Virginia Gun Owners Forum - VGOF

I have a Virginia Concealed carry permit & I am going to take a trip into North Carolina to look at a motorcycle. This being the case I was hoping that someone could point me in the right direction as to the laws there.

I found some stuff on the NC law like you can't carry in a financial institution or places where posted, I'm sure, like in Va. you can't drink & carry but can you go to a restaurant that sells alcohol (even if you don't drink)

Also, what are the requirements to advise law enforcement in case of a traffic stop or checkpoint? Is it mandatory by law?

I appreciate any guidance, just want OK be ok.

One big point is that NC is a MUST INFORM state...supposed to be the first words out of your mouth if you are in contact with an LEO.

I work in Carolina so here's some tips. Each and every town or county has their own laws pertaining to handgun carry. The list on where you can carry is very short. I work in Franklin, Vance, Granville, Wake, Durham and Johnston counties. Be prepared for the fact that deputies and town police for the most part don't know the laws on conceal carry. The troopers though are very professional and know their stuff. Try to avoid Wake county, they are the talk of the other PD's. A few years ago I went through a license check on the way home from work and the cop told me I shouldn't be taking the route I was taking to get home unless I was trying to hide something. So for about an hour or so I was on the side of the road getting searched and threathned a trip to jail because they were convinced I was a drug dealer. I thought it was funny at first but then realized they wanted me so bad that they might put something in the company truck just to prove a point.
If you are going to a rural county then carry, if not stash you rgun somehere in your car but make sure you tell the cop about it if you are stopped.

Kind of negates the "reciprocal" agreement. I didn't know that town & county cound impose restrictions over state law. Does this apply only to out of state permits? If not it hardly seems worth the effort to get a ccw in that state.

Suffice it to say I drive through NC very carefully. I travel to AL a couple times per year to see family. From VA I go through NC, SC, GA, and AL...NC is the only state that gives me the willies carrying...

Sure they can. Virginia was the same way up until a few years ago. NC has a reciprocal agreement with Va., it's just that you follow their laws.

How do counties get away with regulation with a State preemption?

You certainly can drink while carrying. You can also drink (before, not while) piloting your deadly motor vehicle. I'm sure you knew about that one, though. The same standard applies as to blood alcohol content.

Maybe they don't have pre-emption in NC?

Not sure that is correct. How do you interpret the info below? I plan on vacationing in NC in July, so I've been doing some reading and this topic caught my interest.

"2. Assemblies and Establishments
North Carolina law also prohibits any person carrying a gun, rifle, or pistol into
any assembly where a fee has been charged for admission or into any establishment
where alcoholic beverages are both sold and consumed. Again, the individuals
exempted [LEO exemptions] from carrying concealed weapons cited in paragraph III. A. of this
publication are similarly exempted under this law. A concealed handgun permit
does not allow a permittee to carry a weapon in these areas. The following are also
included in this exemption:
a. The owner or lessee of the premises or business;
b. A person participating in the event, if he/she is carrying a gun, rifle,
or pistol with the permission of the owner, lessee, person, or
organization sponsoring the event; and
c. A person registered or hired as a security guard by the owner, lessee,
person, or organization sponsoring the event.
N.C. Gen. Stat. § 14-269."

It is not uncommon for states to have statutes that impose minimum regulations but allow localities to impose stricter requirements. Very common with zoning ordinances, for instance.

During my own frequent trips to NC (I have a daughter in Raleigh), it has not occurred to me that NC might be more restrictive than VA. I keep a Taurus Judge and a Sig 238 in the console of my Tahoe; the thinking being that if circumstances should require I carry on my person the Sig is there and a suitable gun for it. Message to me is leave them both in the console while in NC. What I did NOT know was that NC was a MUST inform jurisdiction. Thanks to ya'll for bringing that to light.

I dont think thats true. The law regarding drinking while CC merely states you cannot drink while in an establishment that serves alcohol...nor can you carry OC or CC while intoxicated.

This is how I interpreted the Va law. I should have been clearer that I only CC. My comment about not being able to drink and carry was referring to CC in a restaurant or bar. It appears NC does not leave the "responsibility" to the carrier. Although I'm not much of a drinker, as a good practice I feel it prudent not to drink & carry to avoid any misunderstandings with LEOs.

So, having a drink while CC in a private setting (in VA) is perfectly fine as long as you do not become intoxicated.

Back to NC though... no CC in any establishment that sells alcohol for immediate consumption, period. I.e., I must disarm to go out to eat at pretty much every restauruant while on vacation...

Meak, in a private setting? You can shoot wearing a banana hammock, and pasties with a "J" in your mouth... it's not PRUDENT, but it's PRIVATE...

Thanks for the info on NC... I was contemplating alternative states besides VA for retirement, looks like TN, and KY are the only two! Can't stand a guv'mint that doesn't trust those who hire them.

It damned sure is. That is why while I will work there, I will live 8 miles away into SC. I hear they have their own kinds of stupid, too. No OC is at the top of that list. I am contemplating a gun cozy complete with frilly lace borders with "GUNS ARE ICKY" in needlepoint on it for my "concealment."

OC is legal in some counties, not many but some.
