OC with one in the Chamber?

Post by Tazguy04 »

I need some help trying to figure out if it is legal to have a round chambered in a open carry without a CHP. I have called the state police and was told two different things by two different troopers. Does anyone know the current Open Carry Laws in regards to this. Thanks for the help

It's legal to have a round chambered while open carrying. The Code of Virginia makes no distinction on the readiness of your handgun.

BTW, getting legal info from cops is generally a bad idea as I'm sure you've found out by now. Oddly enough same goes for gun store employees with the exception of laws that deal with the transfer and sale of firearms.

+1

Exactly. OC is legal because of a distinct lack of laws regulating it.

The VA administrative code states that having a loaded magazine in the gun without a round in the chamber is considered loaded. So not loading the round into the chamber does not affect your legal status in anyway versus just having the magazine loaded.
4VAC15-40-60. Hunting with dogs or possession of weapons in certain locations during closed season.
.....
H. Meaning of "possession" of bow, crossbow, or firearm and definition of "loaded crossbow" and "loaded firearm." For the purpose of this section, the word "possession" shall include, but not be limited to, having any bow, crossbow, or firearm in or on one's person, vehicle or conveyance. For the purpose of this section, a "loaded firearm" shall be defined as a firearm in which ammunition is chambered or loaded in the magazine or clip when such magazine or clip is engaged or partially engaged in a firearm. The definition of a loaded muzzleloading firearm will include a muzzleloading firearm that is capped, or has a charged pan, or has a primer or battery installed in the firearm. The definition of a "loaded crossbow" is a crossbow that is cocked and has either a bolt or arrow engaged or partially engaged on the shooting rail or track of the crossbow, or with a "trackless crossbow" when the crossbow is cocked and a bolt or arrow is nocked.

Perfectly legal. But if you're carrying a single action revolver or 1911 made before about 1920 you probably shouldn't.

That's how you carry 1911 - "locked and loaded" - one in chamber w/safety on

True, but maybe it's good to be aware of what their misconceptions are. My office had "firearm safety training" recently, provided by the local PD. The officer was mistaken on several issues (claimed that it was a felony to consume any alcohol whatsoever while carrying either OC or CC, claimed there is a requirement to register long guns, claimed there is a 72-hour waiting period to purchase any gun (he backed off that one later, stating that the background check could take up to 72 hours)). Most of the info he presented was accurate, but I was interested to see that those charged with enforcing the laws don't always know what the laws actually say. (Not really surprised, though.)

Why would a company seek out firearms safety training from the police ?

I think that I know of a company that conducts this kind of training..

Not a company, a military staff. The training was prompted by several incidents involving servicemembers in other units improperly using firearms. The motivation was to promote responsible firearms ownership -- not at all anti-gun. I was just a little dismayed that the instructor was not as informed as he should have been. I know I've learned a lot from the many experienced folks on this forum, from VCDL, and from perusing the Virginia legislature site. Where is your business located?

Oh, and to be on topic, I always carry with one in the chamber.
