Virginia Gun Owners Forum - VGOF

A friend has a LTCF from Pa. (license to Carry Firearm). She will be visiting her boyfriend in Va. In Pa. A person with an LTCF can borrow a firearm from another person that also holds an LTCF. However, will she be able to carry that firearm in Virginia? Checked the state police web site but coud not find any information about it. Thank you for your help.

Hi Gerry.

Anyone can open carry a firearm in VA (if they can legally own a firearm - i.e., not a felon, not subject to a restraining order, etc).

Additionally, her PA LTCF is honored in VA, so she can also carry concealed.

Since there's no "registration" of firearms in VA, the borrowing of a firearm isn't a problem at all.

IANAL but I dont think the concept of "who actually owns the gun" comes into play law wise for the person who is carrying it. And as Rick said, here in VA it doesnt matter, unless of course the cops run the serial number and find its stolen...

It would only matter if the person she borrowed it from stole it or reports it as such while she has borrowed it. If she is worried about it, have the both of them sign a temporary lease agreement for the firearm in question. Personally, if the person trusts you enough to lend you the gun you probably have nothing to worry about.

You don't specifically state whether your friend is a resident of Virginia or not, but you imply that she is not. If she is not, then transferring a firearm to her possession while in Virginia would be a violation of the Gun Control Act. (While there are certain limited exceptions to that - for "sporting purposes" - I do not think concealed carry would fly if the feds decided to make an example of those involved.)

Good point. It doesn't say if the borrowed gun would be "transferred" in PA or VA.
