Buying multiple guns at a Gun Show
Buying multiple guns at a Gun Show
I understand that if you have a VA CHP, you are allowed to purchase multiple firearms. So, for example, if you went to a store and asked for two handguns, I imagine they'll ask for your CHP before proceeding.
In the case of the Nations Gun Show where I plan to purchase multiple firearms from possibly different dealers, do I need to mention to the second dealer "This will be my second purchase today (or this weekend). I have a CHP." or just proceed without saying a word?
If I'm not required to say anything, it brings up a "Hmmm..." What would stop a non-CHP holder to buy multiple firearms from different dealers at the show? Would it pop up in the NICS check instantaneously stating the person just bought a gun a few minutes ago, enabling the dealer to ask for the person's CHP? Or would the deal come to haunt the buyer later?

Re: Buying multiple guns at a Gun Show
The background check will turn up that you've made a purchase within the past 30 days. I don't know that the dealer will see that, but the VA State police system knows you are a CHP holder, or not a permit holder and should permit/deny the background check based on that information.
There is no requirement for you to inform the seller that this another purchase.... However on the VA form it does ask if you have purchased a handgun in the last 30 days. Your 2nd and subsequent forms of the day (and for the next 30 days) would have the answer of 'yes' in that area. So the dealer will know.
I wouldn't make a big deal about telling the dealer this is my 17th purchase of the day... If they think you are, or might be straw purchasing they will not sell to you and/or may call LEO's to have a conversation with you.

I see. So the person trying to lie will get caught, lose $2, and have a chat with the police. I forgot all about the forms asking about the purchase in the last 30 days. I've been so accustomed to answering "No" on like all the questions except one.
Thanks for the info!
Re: Buying multiple guns at a Gun Show
You are not asked if you have on the forms, but it is written in RED that you cannot purchase more than one handgun in a 30day period unless you meet the exemptions listed, CHP being one of them.
You can buy as many as you like if you meet the exemptions.
That said, if you purchase more than one handgun in a 5 day period, you are required to fill out an ATF form 3310.4, Report of multiple sale or other disposition of pistols and revolvers. This form has to be transmitted no later than the close of business that day to the ATF and State Police.
So, for your own benefit, I would highly recommend you are open and upfront with anyone you do business with.
Hope this helps.

I was under the impression that it was the FFL holders responsibility to file the 3310.4 not the individuals.
Re: Buying multiple guns at a Gun Show
You are absolutely right, it is the FFL holders responsibility to have it filled out and send it on to the ATF, State Police, and keep a copy with his records.
As the buyer you need to let the FFL know, hopefully he is on top of things and asks, but things get hurried from time to time.

Re: Buying multiple guns at a Gun Show
This is more of a dealer record keeping fork on the thread....
I was told when I got my FFL that the 3310.4 is only filed if I transfer more than 1 handgun off my books to a single (non dealer-to-dealer) purchaser in a 5 day period.
If the buyer buys one from me, and then you, and a 3rd from another guy then none of us have completed a multiple sale... hence no 3310.4

This does appear to be clear as mud doesnt it?jdonovan wrote:This is more of a dealer record keeping fork on the thread....

Line 3 says: Any combination of pistols and revolvers acquired in the last five business days... but on the back it gives info stating only when you yourself sold 2 or more to a non licensee, and then if they come back later in the 5 day period, to add those guns to the list.
Before I had my license, I filled out the form at the local dealer when purchasing one within 5 day of eachother, which meets what you were told...
Will have to do some research I guess, as I am now confused, happens rather easily especially on meds. I have a terrible cold and my head is plugged, will have to blame bad info on that.

One form of ID and a 2nd 'something' to prove residency...
Some acceptable forms of secondary ID are:
a current lease,
evidence of currently paid personal property tax or real estate tax,
a current utility or telephone bill,
a current voter registration card,
a current bank check,
a current passport,
a current automobile registration and
current hunting or fishing license.
the address on the 2nd form of ID __MUST__ match the primary ID
Also if what your buying is a 'assault weapon' you have to prove citizenship.
An assault firearm is defined as any semi-automatic center-fire rifle or pistol that expels single or multiple projectiles by action of an explosion of a combustible material and is equipped at the time of offence with a magazine which will hold more than 20 rounds of ammunition or designed by the manufacturer to accommodate a silencer or equipped with a folding stock.

Re: Buying multiple guns at a Gun Show
where I live we had a licensed gun dealer that had a customer purchase a 2nd gun in a 30 day period. the person did the paper work, & police approved it, however it was less than 30 days, & then they wanted to prosecute the woman that bought the second gun, she thought she had been 30 days, but was I think 29 days.
they suponead gun dealer to testify, & he pretty much refused & told them where to go & gave up his FFL over this & refused to sell another gun, they had told him everything was alright, but it wasnt. & had lied to him. he was retired & selling guns on the side, & was a former police officer & a former Sherriff. we lost a good gun shop over that mess. the woman had made a mistake & he refused to help prosecute.

Re: Buying multiple guns at a Gun Show
It won't know unless you tell it. When the dealer is entering the info into the system they ask if you've made a handgun purchase in the last thirty days, and if you have a CHP if you did. If you bought one and don't tell them, the system rejects the check.jdonovan wrote:The background check will turn up that you've made a purchase within the past 30 days. It's another reason we need to ditch the one-per-month law and the state-run background check system.
