VA lawsuit passes first test,

A lawsuit brought by VA Attorney General Ken Cuccilini declaring the Obamacare mandate unconstitutional has cleared the first hurdle as the judge in the case refused to dismiss it to suit the administrations charge that it is not enforcable.We could be the leader in this thing in America today that other states will follow and help to get this nasty peice of crap repealed or at least knock the bite out of it.

Virginia's lawsuit challenging the Obama administration's health care reform law has cleared its first legal hurdle.

U.S. District Judge Henry Hudson on Monday denied the Justice Department's motion to dismiss the lawsuit.

Virginia Attorney General Ken Cuccinelli claims that Congress exceeded its authority under the Constitution's Commerce Clause by requiring citizens to buy health insurance or pay a penalty.

The Virginia General Assembly passed legislation this year exempting state residents from the coverage mandate.

More than a dozen other state attorneys general have filed a separate lawsuit in Florida challenging the federal law, but Virginia's suit is the first to go before a judge.

Let's hope that this case creates enough precedence to help push the cases pending in other states. The once unstoppable Obamacare machine may be starting to run out of gas.

This will defintely help,,, All the other states joined the FL case and if it sees a judge and gets shot down they are ll gonna have to reboot while VA's moves ahead,,

Perhaps next, the AG needs to file a claim against Kagan being unconstitutional.

If VA wins this will essentially call for the repeal of at least that portion...I honestly cant see any judge seeing that forcing us to buy something is Constitutional...but I know they are out there...

Well then he needs a few billion dollars for another "Cash for Clunkers" scheme so that he can trade it in for a newer model with better "efficiency".

I'm more concerned with just what is Obama and company going to do and who and who are they going to stroke for more votes if this lawsuit gets momentum and eventually wins.I hope the God it does..Step one... in getting this Republic back from the brink of diasaster.Obama has shown that he is not beyond the radical approach to getting what he wants,Remember in November is the new battle cry and needs to be promoted without restrictions on it;s intent. To elect Constitution supporting candidates that will bring the country back to where it should be.
