Need an attorney for Arlington County, VA

Request: Can anyone recommend a few attorneys (or a list) who are equipped to dealing with gun laws and serve Arlington County general district court?

What happened: A friend of a friend was arrested carrying an unfinished (brand new, unaltered) 80% lower receiver through the DCA airport TSA checkpoint. It was a gift and she was not well educated or spoken about what it was, so they threw the book at her. She was released, but summoned to appear in court for violation of Virginia criminal code 18-2 287.01 (http://law.justia.com/codes/virginia/20 ... 87.01.html) and faces a class 1 misdemeanor, a year in jail and $2500 in fines.

This is nonsense. It's a friggin' piece of plastic. However, it should be taken and dealt with seriously.

Advice / recommendations appreciated.

I don't know 100% for sure, but they are based in Arlington, so I ASSume they service the courthouse in that county.

Yep, it's a piece of plastic. The problem is the wording of the statute where it includes frames and receivers. Does an 80% lower qualify as a frame and/or receiver? Hopefully your friend of a friend's future attorney can argue that it does not.

You can look here:

http://www.vcdl.org/ << click Resources/Gun friendly lawyers and view the list

I heard/read that John has participated in re-writing of some issues according to Philip Van Cleave - pres of VCDL.
I don't know if John would have an interest due to his and your location.

Any lawyer who has passed the VA bar can represent anywhere in VA. This would be a great case for Ken Cuccinelli.

This person should have never been arrested and any lawyer worth the air they breathe should be able to get the charges dropped. Based on federal law, an 80% lower is not a firearm, frame or receiver because it is not "finished" enough to actually receive ammunition, a trigger package or act as a frame of a weapon to connect a barrel, making it incapable of firing a projectile and therefor does not require a serial number or background checks to sell new. There are no State level laws defining a firearm differently, which is why we can buy 80% lowers in VA without a background check.

It just more of the liberal poison in NOVA, looking to make an example out of a law abiding citizen who the Libs disagree with.
