Virginia Gun Owners Forum - VGOF

Hi everyone,

It's nice to find this resource, this is my first post.

I recently moved to NOVA and I'm waiting for my VA driver's license to arrive in the mail, at which time I will apply for a VA carry permit. I currently have a Florida non-resident permit and, of course, Florida has reciprocity with VA.

I am certain that I can carry in VA on my FL permit, since I still have my out of state driver's license. However, when I get my VA driver's license I will immediately be a VA resident.

So, can I carry in VA on a FL permit until I get my VA permit? I know states are all different on this.

I would have to say that this would be up to the officer with whom you had contact at any given time during the transition. As long as you still have your FL driver's license with you and can point out the effective date on your Virginia license - along with a copy of your Virginia resident CHP application that was submitted within the 45 day window, I would guess that you would be OK to CC. Now, IANAL, so take this advice for what it's worth... Free!

I agree with Rick... have your paperwork with you just in case during the transition.

And I'm also not a lawyer, but from what I'm reading at http://www.handgunlaw.us/ is that VA honors FL permits even if the permit holder is not a resident of FL. Florida seems to be the other way around, where you must be a resident of the state in which the permit is issued.

You don't need a Va drivers license to be a resident, and you dont have to show your license when you apply for your permit. Also, there is no minimum time of being a resident before you apply.

Ah, I suppose I don't have to wait to apply then.

I think that the processing of the permit would include verification of residency, which can be proven by either a driver's license or a state-issued ID card. I think you would be better off to get your DL then apply - but, again - IANAL.

........An application is deemed complete when all information required to be furnished by the applicant is delivered to and received by the clerk of court before or concomitant with the conduct of a state or national criminal history records check.

All information required to be furnished is the info that is asked on the application, like your address. When you swear under oath to the clerk, under penalty of perjury that "all information contained herein is true and accurate to the best of your knowledge and belief", well that is all that is really required - its the honor system.
