DC Carry Meet and Greet 10/24/14 (TBD)

As many of you are aware, it was legal to carry in Washington DC after the judge ruled DC's handgun ban was not constitutional. It lasted for about a day and a half before the DC attorney general filed a motion to stay the decision, and that motion was granted yesterday, so it's again not legal to carry in DC.

The judge granted a 90-day stay in order to allow time for the DC City Council to determine how they intend to handle the situation, either with new (likely onerous) gun control laws, or with an appeal of the decision to the Supreme Court.

The 90-day stay expires on 10/24/14, and the new group "DC Carry" on facebook intends to show up at the Jefferson Memorial on that day, assuming it is legal to do so at that time.

I'm not sure the stay means it's not back to being illegal. Also, DC police chief has not changed or corrected her previous order. Do we have any practicing lawyers on the board?

"Stay" means that the presiding judge has set his order aside for 90 days in order to allow the defense to improve their position relative to the ruling (i.e, prepare a filing for appeal, or make laws to work around the ruling). After 90 days, the ruling will either go back into effect, or DC will have filed for an appeal.

Chief Lanier did sent out another APB to the force indicating that all gun laws are to be enforced.
DC Police Chief Lanier wrote: Judge Frederick J. Scullin, Jr. of trhe U.S. District Court, issued a stay of his order of July 26, 2013 in Palmer v. District of Columbia[...] Implementation of his order is delayed for 90 days while the stay is in place. Therefore, Teletypes 07-137-14 and 07-138014 are rescinded. All laws related to firearms regulation and crimes remain in effect.”

The upside is it has been challenged and said to be Unconstitutional. Downside is they have 90 days to alter it and try again.

Here is their page but I don't see any announcement about their Carry Day. Perhaps they pulled any info pending more information on the stay order.
