Fox news had that footage last might. Guess it sure enough is a good idea to stay in the car when they stop you. But I was once told when I was a boy to get out and meet the cop halfway; that it was a matter of respect for the cop. The guy that got shot might have remembered the same instructions from his youth. I guess back then the cops didn't have to worry that everybody they stopped was a cocaine mule or a terrorist. Seems like the world just keeps getting uglier and uglier.

Not sure where the deputy was in the wrong?? Seemed legit to me. Long narrow pointy thing in the dark. Interested to see if they prosecute and the resulting outcome.

Tough story. Glad the senior survived. That would be rough on anyone, let alone a 70yr old.

Dad told me that he almost shot a hog. He was hunting squirrel at the time. He expected to see a squirrel. He WANTED to see a squirrel. When the squirrel grunted it became a hog. Glad the old guy survived.

The sheriff is a little short on grey cells if he thinks the public could be educated on police interactions.

I can definitely see the Deputy's side of it. If it HAD been a shotgun and he'd hesitated, he might have been dead. Was it poor judgment and being too quick to shoot? Well, he shot a 70-year-old vet with a cane in his hand, and that is just an awful thing. That kind of makes you want to burn him because of the results of his action without giving him any credit for his benign intent, but can you honestly say you wouldn't have made the same mistake? I think maybe the way I'd come down is that while he maybe he ought not to be prosecuted, he also probably shouldn't be a cop with a gun making traffic stops anymore, either. The inevitable civil suit will probably be quite a significant punishment given the officer's emotional reaction on the tape.

You know they would. Try this out for size. No traffic stop, person has a flat and on the side of the road sitting in his car. You pull over to help when you see an elderly person stopped with their flashers on. As you walk up the the car, the guy grabs his cane and starts to get out of the car, it looks like he aims it at you like a rifle. You don't know what it is, fear for you life because you think someone is aiming a rifle at you and you fire.

In that situation, you know you're going to jail and anything but is going to be a long and expensive miracle.

Tough story. I guess the times are a changin because I was taught to stay in the car and keep my hands visible (especially at night).

I never heard about getting out and meeting the officer half way but if that's what was taught back in the day I can see how this happened. Real sad situation.

The old guy is lucky the cop is a poor shot. Hard to count the rounds, they're shot so fast, but it still sounds like 6 or 7 rounds fired.

I doubt the cop would be prosecuted. The majority of the time (right or wrong) they are put on administrative leave for the investigation period and usually no charges are filed. Even when its obvious they should have been. Do some research on the internet. I'm not saying the guy should have been charged this time. He made a mistake, he thought it was a shotgun. If you make a mistake, will the cops arrest you and charge you and will you go to trial? Think about that.

I got to say, that is one tough dude. When the cop asked him where he was hit, he said "my stomach. It hurts real bad, but I'll be alright." I'd be cryin' like a little girl.
