This article is suggesting that even spent casings, brass, etc. is considered ammunition and may cause arrest in DC.

For what it's worth, the Code of Federal Regulations actually defines a casing as Ammunition even if it's not loaded.

Title 27 - Alcohol, Tobacco Products and Firearms
§ 478.11 Meaning of terms.

Ammunition. Ammunition or cartridge cases, primers, bullets, or propellent powder designed for use in any firearm other than an antique firearm. The term shall not include (a) any shotgun shot or pellet not designed for use as the single, complete projectile load for one shotgun hull or casing, nor (b) any unloaded, non-metallic shotgun hull or casing not having a primer.

So... in practice, if I have a shell casing that I have seen fit to use as a key ring, that will get me arrested in DC.

Hence why I do not drive into DC. It would take me hours to comb through my truck and make sure I didn't have a single shell casing in it. And even if I did get it that clean, it would only last til I went shooting again.

This law creates a logistically nightmare for me. I am in sales and my office is in VA but I might have to got to DC and MD with a few hours notice. Most times I do not have time to go home to put my firearm away.

OH Crap.. I stopped by a couple of Walmarts this morning and picked up 6 30 round boxes of American Eagle .223 stripper Clips 180 rds in my trunk
before I went to DC for a Meeting ........ Thanks for the Info .. I will never do that again

heck you can't even own Mace in DC. they don't want you to defend yourself at all there.

It's nuts bro. I went to PA a few weeks back. Drove around DC to avoid that crap, but had to keep my stuff locked up all the way through MD.

DC code § 22-2511. part A says it is unlawful for a person to be voluntarily in a motor vehicle if that person knows that a firearm is in the vehicle. the penalty is 5 years and $50,000! LOL They are nuts.

Something I find equally absurd is DC code § 7-2502.02. part 6 (prohibited weapons) literally says "An assault weapon"; but with no definition of what and assault weapon is. How freakin' vague can you get. Isn't anything you use to commit an assault and an "assault weapon"?

I find it amazing that the politicians in DC would prefer you be a victim while they are exempt from the firearms regulations and have teams of armed security everywhere.

§ 22-4504.02. Lawful transportation of firearms


(a) Any person who is not otherwise prohibited by the law from transporting, shipping, or receiving a firearm shall be permitted to transport a firearm for any lawful purpose from any place where he may lawfully possess and carry the firearm to any other place where he may lawfully possess and carry the firearm if the firearm is transported in accordance with this section.

(b) (1) If the transportation of the firearm is by a vehicle, the firearm shall be unloaded, and neither the firearm nor any ammunition being transported shall be readily accessible or directly accessible from the passenger compartment of the transporting vehicle.

(2) If the transporting vehicle does not have a compartment separate from the driver's compartment, the firearm or ammunition shall be contained in a locked container other than the glove compartment or console, and the firearm shall be unloaded.

(c) If the transportation of the firearm is in a manner other than in a vehicle, the firearm shall be:

(1) Unloaded;

(2) Inside a locked container; and

(3) Separate from any ammunition.

I thought that only applied while actually travelling and didn't apply if you stopped. Besides, DC has been ignoring that for quite a while as the general recommendation has been to simply stay out of there while having any firearms stuff in a vehicle.

That's the tough thing about the law, I think if you're driving though you're OK but if you stop for any reason you could go to jail. To make matters worse DC is pushing LE to make the arrests rather than use their discretion.

Emily Miller will be speaking again at the VCDL monthly meeting at the Mason center, focused on her new book. I heard her speak earlier this spring about her DC experience in legally obtaining a firearm in DC....it is well worth listening to her...she is a real thorn in the side of the DC Police leadership and City Council....plus, she is easy on the eyes!
