The person who wrote the report cited above seems to think that Burress should have gotten a lesser sentence for carrying a firearm into a night club and shooting himself in the leg with it.
I am of the opinion that his sentence was about right since he didn't have a CHP and he recklessly endangered everyone around him. It's lucky that the gun went off into his leg instead of into someone next to him.
As Anti-Gun as New York is, I really don't think they went after him. I think he got what he deserved.

Carried a concealed weapon without a permit, it was unsecure (report I heard stated he had it stuck in his belt or waistband), it fell out and discharged hitting him. Yep, 2 years is about right.

I don't know - two years is a long time if he has to actually do the full term. As a Virginian, I am anti-bloomberg so I doubt that he and I will ever agree on anything to do with firearms. I do agree that reckless endangerment deserves appropriate consequences and I abhor the "famous" who think they are above the law. However, a DUI who crashes him/her self usually does not get two years on a first offense and they are probably more dangerous.
Just my two pennies.
Btw, I would not have let Vick back in the NFL for at least another year, but thats another subject, eh?

How can you honestly say 2 years is a good thing, EVERY individual who is able to buy a hand gun should be able to carry it in the manner they feel will protect them the most. Freedoms are not taken by tyrants, they are given away by citizens who know-not what is being lost.

However, your rights end where others' rights begin. Everyone has the right to go into a nightclub and expect that their life is not in danger due to negligence of another patron. He was carrying a pistol in the waistband of his SWEATPANTS. When it fell free and headed for the floor inside the leg of his sweatpants, he tried to catch it and in so doing, it discharged.

A lot of bad decisions on his part which could have resulted in someone's untimely demise. His irresponsibility with a handgun is what the antis use to scare the public into thinking that everyone who carries a firearm acts just as recklessly. Reckless endangerment is not what he plead guilty to, but it is what he was indited with. Reckless endangerment is only punishable by UP TO ONE year in prison and it is a misdemeanor not a felony, so what would you like him charged with? I agree he was guilty of reckless endangerment but giving a man 2 years and a felony is crazy.

Yes, I fully agree - but any bonehead who carries a pistol in the waistband of his sweatpants should consider himself lucky he didnt shoot himself somewhere it would have really mattered or someone else. IMO 2 years is getting off easy. I strongly support the 2nd Amendment but we do have to live with laws - whether Constitutional or not. And let us not forget this little thing called common sense.

One year max, its the fitting charge and the fitting punishment (according to the Peoples Republic of New York). If we are to live by laws we should live by the ones on books, so long as they are constitutional.

I may be full if it (be far from the first time), but my understanding is this....though reckless endangerment itself may be a misdemeanor charge, any crime involving a firearm becomes a felony simply by involving a firearm. If it had been reckless endangerment through other various forms of stupidity, the up to one year thing should have been applied. The fact that the stupidity in question involved a gun ,which itself was also carried illegally at the time, exacerbated the situation and the sentence. Now if I'm way off base, someone please correct me

great stuff...
anyway...
the item that leaves me with a big question mark is that from what i understand (and i certainly could be wrong) is that the pistol he was carring was a Glock...how did THAT pistol dioscharge with out a pull of the trigger...and he could haev had the trigger worked on, but i can tellyuo that the un-adjusted pull is not what i would call "short" by any means...
A Glock should not go off by being dropped...anyone know the details on this piece of it??

My theory after reading some details,,, He was seen fumbling with something in the area of his waistline,, Witness' s say they heard a pop then after saying take me to a hospital the Glock fell out of his pant leg covered with blood ,, IMHO he had his finger on the trigger as he tried to adjust the position of the gun while he held onto his cocktail with the other, Wrong move and the gun went off. Lucky he didn;t neuter himself .., I put a NY trigger and 3.5 connector on mine to stiffen the pull up a bit to help avoid the dreaded Glock leg that cops and dummies seem to do all to often,,

Two years is about right IMO. He could have gotten a lot more, it doesn't matter what he plead guilty of, he could have gotten a LOT more than 2 years. Let's see what he could have been charged/convicted of: Possession of a hand gun in NYC, concealed HG, possession of HG in a bar, drinking with a HG, discharging a HG in city limits, discharging a HG in a crowded bar, wreckless handling of a HG, and shooting someone(himself). All of those charges could have added up to WAY more than two years.
One news outlet reported that he had the gun in the waistband of his sweat pants, it started sliding down his pant leg and it discharged when he tried to catch it.
My question is this, why would someone want to be in a place where you feel the need to carry an illegal weapon in to feel safe?
