I'm about to file for an SBR and buy a suppressor. Now I'm thinking I should do a trust. Who can do one for me? I'm in Fairfax County. A saw arsenal attourney's via google, but I wanted to hear from someone here on the forums first.

My SBR lower is already engraved with my full name and town. I haven't submitted paperwork yet to ATF. Can I make the trust my full name and not have to re-engrave the lower?

you do know you can do an LLC and do the same thing as a trust?

No, didn't know that. Already ordered the trust, so going with that.

What's involved in starting an LLC? Do you have to file taxes and do other work to keep an LLC going?

@Zimm17- I know different Trusts may have different factors involved, but can you tell us what the ballpark cost is for a Trust setup by Arsenal?

I was advised that a forming a LLC and holding NFA items, those items would constitute business property and be subject to anual tax... so I went the trust route.

Doing an LLC for NFA is not a good idea. LLCs must be maintained through annual filings, tax returns, etc. If VA invalidates your LLC for something like a late filing you are now in possession of NFA items without authorization....not a good place to be.

Arsenal did my trust, top notch. Spend the money for the peace of mind this is not something you want to cut corners with or try to work around with LLC etc.

Worth every penny. Also make sure you ask about their perpetual trust.

I have been postponing some projects. I did the corp, but things have changed. I think the trust may be the way to go.

Contacted several law firms that advertised specialities in NFA trusts in the state of VA. ArsenalAttorneys is the obvious big one, contacted them first but found them to be too pricey even by NoVA standards. I did have a very informative call today with Attorney Michael Coster from http://www.resolvelaw.com and he offers generous discounts for Retired/Active Military and life members of the NRA, VCDL, etc. Mr. Coster followed up my inquiry with an immediate response and answered all my questions on the phone before I was ready to commit.

In regards to putting weapons in an LLC, its good if you are in a business that does firearms related stuff. However, fail to keep your business in good standing, fail to file taxes monthly/quarterly or if the state decides to revoke your license than congratulations, you are now a felon. Having the class weapons in a trust is like an LLC but without the paperwork headaches and revenue generation.

Do you ever hear of someone who is trying to do it right getting 10 years and $250000 in fines?

I haven't. It is always someone who is trying to push the limits.

They know the shotgun should have an 18.5 in barrel, but they cut it 16. Then they don't toss the barrel they keep it.
OR
They buy all the M16 parts they can except the registered part and let a gun start doubling and trippling. Then don't fix the issue.

Typos get used get pile on charges on people who have been pushing the limits or have out and out violations.

I would hate to rely upon prosecutorial discretion being wielded in good faith and charity for a gun owner's honest mistake by the Obama administration. Very bad odds on really high stakes IMO.
