Tennessee Gun Law Invalid?

The ATF steps in on Tennessee's recent Firearms Freedom Act. I picked this up at the MD Shooters discussion board. I wonder if they've said anything to Montana.

I'm sure they will get around to them and the others,, This will end up in the Supreme Court if the states continue to pursue the in state exemption.

It'll be interesting to say the least. Federal law is based on the assumption that it is interstate commerce and Congress can regulate based on the Constitution. I guess the ATF doesn't believe in the Constitution.

I saw a report that Montana was looking for someone to test this, as I understand it their law doesn't go into effect until October. Their plan is to find someone that's "squeaky clean" to send a letter to ATF telling the ATF they plan to build and sell a limited run of rifles, then proceed to do so. I don't believe they planned on using someone with an FFL of any type. Since the people addressed in the letter to Tennessee FFL's already hold an FFL it's probably not a good idea for them to attempt manufacturing a firearm without following federal law. I think this cause would be better served if someone without any type of FFL made the initial challenge.

You know that brings up a thought I've been pondering recently. Why do these states with strict gun laws like MD and NY have big gun manufacturers there. An even better question is why do the big gun manufacturers have plants in states with strict gun laws. Beretta is in MD of all places and Dan Wesson and others in NY.

The manufacturers don't look at the 2A side of it, they look at the business side of it. Dig deep enough and you'll find something that provides them a business advantage to be in the particular state they are in. Tax breaks, interest free loans, assistance in building new facilities, and who knows what else offered to come to a state.

Yes, its obviously a business issue. Just think its a little off base. IMO anti-gun states should not be allowed to have the gun industry in their state. If the cant allow the people to exercise their rights why should be allowed to get any revenue because of it.
