Personal sale of AK with folding stock

If you are selling from your personal collection, (not a firearm dealer) to another person (who also is not a firearm dealer), do you have to do an FFL transfer on an AK with a folding stock? I have found mixed ideas about this. Please provide some supportive evidence if available.

In addition, no dealer shall sell, rent, trade or transfer from his inventory any assault firearm to any person who is not a citizen of the United States or who is not a person lawfully admitted for permanent residence. To establish citizenship or lawful admission for a permanent residence for purposes of purchasing an assault firearm, a dealer shall require a prospective purchaser to present a certified birth certificate or a certificate of birth abroad issued by the United States State Department, a certificate of citizenship or a certificate of naturalization issued by the United States Citizenship and Immigration Services, an unexpired U.S. passport, a United States citizen identification card, a current voter registration card, a current selective service registration card, or an immigrant visa or other documentation of status as a person lawfully admitted for permanent residence issued by the United States Citizenship and Immigration Services.

No, you do not. Private sales among VA citizens do not require a FFL transfer on either parties side.

Its your gun!!! Sell it to whoever you want and be done with it. No different than selling an AR15 to anyone ,right?? Fortunatley here in VA we have in our favor that we can deal / sell privately and the Fed and State can mind thier own damn business like they should

It makes no difference what kind of stock your AK has, it's just a semi-auto rifle in Virginia. Private firearms sales between two Virginia residents is perfectly legal.

However, VA law does require that before you sell any AK-pattern rifle you must email me with the offer first. Just in case I need another one :friends:
