Nova - good reply, but you are missing the point of the argument. There has already been a court decision out of Fairfax regarding proving your residency, so that is not an issue. Certainly, one is expected to show their id to the court clerk to verify that the name and address on the application match the id provided. That is described in 18.2-308 D. That's the point where id stops. When the clerks accepts the app and sends it off to the judge, the judge is simply supposed to verify that the proof of competence has been met regarding firearm safety training (18.2-308 G). Once the app reaches the judge, the assumption by the judge is that everything else has already been checked and verified by the Clerk, as is their job. 18.2-308 says words to the effect of "residents of the city or county". Nothing about proof. The burden, then, is on the court to ensure only "residents of the city or county" are issued CHP. They do this by verifying that you are who you say you are. Your VA driver's license does that, and it states where you live. Saying, "show me in the code where I have to give my [xyz]" open the door to the reply, "Where does it say we can't ask for it?"
