Some have inquired as to what initiated this action. The first email stated "that VA being an open carry state and it not being illegal to carry a gun" as the rational. The second more recent email stated "numerous community complaints regarding the discharge of pellet, paint and bb-guns throughout all sections of the community", two totally different rationals. I can understand restricting negilant discharge and reigning in unsupervised minors as there are already codes for that in VA and PWC. But just uniformely trouncing everyones righst is a little dranconian. About as stupid as Public School Zero tolerance policies.

Think of THAT! And have a "Fall Fling", and a "Spring Sprung" party so neighbors can get to know each other.
Would love to live in such a community. Perhaps with streets named, Remington Way, Winchested Blvd, Colt Lane, Ruger St ... That would be cool!

I like that! I remember the movie "The Green Berets" , and "Sgt Provo's requests" to have a building named after him in death, but make sure it "sings", and they came up with "Provo's Privy".
We have to have "Smith", and "Wesson" intersect, just like "Sturm", and "Ruger" have to intersect. It just HAS too! But I was thinking only have U.S. Gun manufacturers, "Savage St", "Colt Court", "Winchester Way", "Remington Rd"...etc. The garbage dump and Sewage Treatment Plant can be located on "Brady Blvd".

We'd have to make provisions for Ruger road to eventually connect to brady, and block off the connection to the rest of town. Then we can let the road go into disrepair. Once the residents of Ruger begin taking care of their own road then we can block the connection between the two roads entirely, and finally reconnect it to our community.

At these parties, the food of choice should be 'smoked' and a 'failure to feed' should result in a 'positive ejection'.

Side walks and roads are public property and the HOA cannot restrict the possession/carrying of weapons on state/county property.

That is not always the case. It could be "common" area that is owned by the HOA or the builder. If the streets and sidewalks are owned by a person or entity and not turned over to the state/county/city, they do have the right to limit how their guests/tenants use that land.
I personally would never move to an area that has a HOA. I'll be damned if I am going to trade decades of my life that I will never get back for personal property, and then someone else is going to tell me what to do with it.

You might want to ask an attorney if you can sue the board members personally under these laws...

What about the VCDL? have you let Phil know about what is going on here. Just email him and if nothing else he may be able to give you some advice on how to deal with this situation.
Also I was not aware that HOA's could trump Stae laws. By this I mean that the discharge of pellet, Paintball and BB guns on ones on property is alowed as long as it does not leave your property.

In Northern VA, you may not have a choice. It's getting harder and harder to find decent housing in the DC area that is not HOA.

Yes I know Phil and he put me in touch with an attorney that has provided some (so far) pro-bono advice which was helpfull. Phil also was able to get some HOA VDCL members in touch with each other. That is how we got started. If these regularions stick, Dominion Valley just might become the largest gun free zone in Virginia (outside of military base).

I lived under a Nazi hoa in the first house I ever purchased.
"NO HOA" is now the first check off box when I look for a residence.
