You know, asking a bunch of Virginians about Maryland law is silly. Ask that question here: http://www.mdshooters.com/forumdisplay.php?f=9

Regardless of whether or not the residence is mine, with the consent of the homeowner, is it not legal to bring a firearm into that person's residence (making it the direct transport to a “legal destination”)? Just a thought.gunderwood wrote:The Federal law says that the firearms must be legal at both your starting location and your destination. Technically, your destination is in MD (i.e. the purpose of the trip) and once you are there, all local laws apply. Your friends house is not your residence, nor any of those exceptions, so the Federal law probably would not apply. INAL though.
Good point. And you’re right. But, I wanted to discuss and share opinions on this here for the benefit of this forum, too.jrswanson1 wrote:You know, asking a bunch of Virginians about Maryland law is silly. Ask that question here: http://www.mdshooters.com/forumdisplay.php?f=9

It depends on the state. Some states have mandatory handgun registration (often called "permits"). I for one, hate going to MD and Lord willing will never live there. The only thing I willing do in MD is drive through it.YuDanJa wrote:Regardless of whether or not the residence is mine, with the consent of the homeowner, is it not legal to bring a firearm into that person's residence (making it the direct transport to a “legal destination”)? My solution with regards to MD is quite simply...I do not go near MD unless absolutely required...and that hasnt happened for some time...
No more catchy slogans for me...I am simply fed up...4...four...4...2+2...

He's right. It then becomes a question of whether or not the state can prove the case against you with evidence that proves the case beyond a reasonable doubt with respect to the specific crime alleged in the indictment/warrant/summons/complaint. And then it's also a matter of defense.YuDanJa wrote:Seriously? Did you just read the subject line and post a reply?...ProShooter wrote:The simplest answer is, that you can be arrested anytime, anywhere, for anything.
With respect to your hypothetical, my response would be, "As you can see, I am not wearing a gun." If you have a Va. CHP, which is valid in Penn. as well as W.Va., and you're en route to a destination in one of those places, then the U.S. Gun Control Act of 1968, as amended (Gun Owners' Protection Act) makes it legal for you, regardless of state law to the contrary, to carry your stuff through Md. in the way you describe. Again, you may be arrested in Md., in which case, your intention to go straight through Md. on your way to the more civilized W.Va., becomes an "affirmative defense".
You are never required to talk to cops except if you know someone is planning to commit an act of treason against the U.S. You should say, "If you're planning on stopping me for interrogation, and I'm not free to leave, then I want my lawyer." and then just shut up. Never, ever, give consent to search you or your vehicle. Don't fight with them about it, and be patient and calm, but don't give in to their histrionics, either.

MEEEE TOOO!!! I don't cross the Big Water unless I absolutely have to. I have an associate in Rockville who takes care of anything I need done in Maryland.zephyp wrote:My solution with regards to MD is quite simply...I do not go near MD unless absolutely required...and that hasnt happened for some time...

Competition is one of the "great levelers" of ego.

I have to deal with some manufacturers in Maryland. It's a huge hassle - I mean, it's nice that I can drive there because I hate shipping machineguns, but it's never a fun drive once I hit the Wilson Bridge.
Huh. I'd thought misprision of felony was only for agents of the state now. Learn something new every day...user wrote:You are never required to talk to cops except if you know someone is planning to commit an act of treason against the U.S.

That is quite outrageous. I'm gonna look for more information on this case. It is hard to believe that the conviction would be upheld upon appeal if the facts as presented are true.Chasbo00 wrote:Here is a nightmarish related story...

Same here. We've made nearly everything illegal to do without state permission, so I guess the next step is to begin compelling people to buy healthcare and such.Diomed wrote:I have to deal with some manufacturers in Maryland. Re: Can I be arrested if I...?
I am so happy that I retired from Law Enforcement over 15 year's ago in the state of New Jersey. When they will let a stupid ass judge like this asswipe sit on the bench and decide what the law is in his opinion and not permit the jury to hear pertinent data for the case and then put an innocent man in jail for 7 year's. Where is his attorney with an appeal ?

I avoid going into MD, to the point I sometimes route through VA on 50 to Morgantown, rather than I-68/70.
