In can understand why FFLs wouldn't want to risk their license on the word of the buyer, but I can prove I own a home in VA, and clearly am physically standing in the state. There is no requirement in the BATFE residency definition pertaining to how much time one spends in VA. Nonetheless, recording a VA DL is a safe position for FFLs, and I don't blame them for being cautious - I'd probably do the same. Fortunately I am in no rush to get a handgun, but if I can find a private seller willing to accept my residency, then I'll probably buy.

I suppose I could turn in my NJ DL for a VA DL, but I'm not sure how that affects the other definitions of residency. For example, would I now have to change my vehicle registrations, car insurance company, pay VA taxes, and vote in VA? The proof of residency requirements for a VA license only include documents with a VA address such as a tax or utility bill, but not proof of how much time you spend at that address. Strange.

Probably not worth all the hassle. When my mother passes we'll sell our NJ house and make the permanent move to VA, and then buy all the handguns I want!

Maybe I'll write to BATFE with my situation and see if they agree I am eligible to buy a handgun. Wouldn't it be great if they gave me a "to whom it may concern" letter saying please sell this guy anything he wants! Hmmmm, I doubt it. :roll:

Good luck with contacting BATFE.

From what i understand they have six(6) agents at one(1) office to handle all the NFA (National Firearms Act) Tax Stamps for various transferable restricted firearms (like machine guns, suppressors, short barreled rifles, destructive devices, etc.).

It used to be it took 3 months, then 6 months, and now it's apparently up to 9 months to have a Class 3 FFL sell you an NFA item and the time you get issued the tax stamp (after paying $200 for the "privilege") so you can actually take possession. This is simply another example of how our government is doing as much as possible to make it difficult for law-abiding citizens to own firearms and manufacturers and sellers to do business.

The demand for suppressors is (you'll excuse the expression) exploding, but when it takes 9 months of bureauCRAZY and an additional $200, plus having to have a local LEO office approve, figerprinting, etc. is it any wonder that few run that gauntlet, even if they know they "can" (in SOME states) legally buy them in the first place?

There is a reason why you are facing the dilemma you are in trying to protect yourself. The ever increasing (and often conflicting) rules and regulations are piling up intentionally to make it as difficult as possible.

As I said previously, you should consider joining the NJ Second Amendment Society which is doing its best to fight back even more laws in NJ and trying to get the worst ones (like handgun purchase regs) amended. They are currently suing NJ over the most egregious ones. The waiting times for Handgun Permits being issued is unbelievable there.

California requires a 10 day waiting period on all firearms and now long guns are registered like handguns. For some time the 10 day waiting period precludes all CA residents from purchasing long guns while traveling out of state. There was a time that I had a residence in CO and CA with a DL in CA and a photo ID plus other documents so I could purchase in both states.

I have nothing what so ever productive to add, I just wanted to welcome you to SWVA.

The land is me and my daughter's favorite place to visit... from fishing to camping, and the only "legal" place to shoot, Potts range...
