In its decision, the Court held that the student’s right to express their political beliefs as protected by the First Amendment outweighed any argument the school could make that its actions were necessary to keep discipline and order in the school:

The school officials banned and sought to punish petitioners for a silent, passive expression of opinion, unaccompanied by any disorder or disturbance on the part of petitioners. There is here no evidence whatever of petitioners’ interference, actual or nascent, with the schools’ work or of collision with the rights of other students to be secure and to be let alone. Accordingly, this case does not concern speech or action that intrudes upon the work of the schools or the rights of other students."

I hope that this case moves up the chain and these people who are prosecuting are fired, thrown out of office etc. All too often rights are trampled by this "obstruction" garbage that simply denies a person their Constitutional rights.

I saw a thing saying that 100 other kids wore that exact same shirt to school just a few days later. Even kids get the first amendment. Muahahaha!

Update: Sanity prevails! Criminal charges have been dropped.

It remains now for the teacher, cop, principal, and anybody else that had anything to do with using the criminal justice system to brutalize this kid to be taken to the nearest hangin' tree and there suspended by their gonads until gangrene sets in. THEN justice will have been done.

True, but making them spend even more time with lawyers would be a sufficient punishment as well.

Hope that kids family sues the $h!t out of the school system and police department.

While it's good that the charges are dropped, this whole thing should never have happened to begin with.
